يواجه الشعب الفلسطيني واحدا من أصعب التحديات التي واجهها منذ احتلال الأراضي الفلسطينية في الضفة الغربية وقطاع غزة عام 1967. وبالنظر إلى الهدفين المعلنين لإسرائيل في غزوها الحالي لقطاع غزة، وهما تدمير قدرات حماس العسكرية ومنع عودتها إلى الحكم، فإن إعادة احتلال أجزاء من قطاع غزة أو قطاع غزة بأكمله أمر لا مفر منه. إن التخفيف الصريح أو الضمني لأهداف إسرائيل، وهو أمر مستبعد جدا في هذا الوقت، يمكن أن يغير هذه الحتمية بشكل كبير من خلال فتح الباب، على المدى القصير، للتوصل لاتفاق لوقف إطلاق النار، وعلى المدى الطويل، للتفاوض غير المباشر في المستقبل مع حماس حول ترتيبات محتملة طويلة الأجل لمستقبل قطاع غزة. إذا لم تتغير أهداف إسرائيل الحالية، فإن الحرب ستستمر لفترة طويلة وستصل الدبابات الإسرائيلية إلى جميع أنحاء قطاع غزة. ماذا سيحدث بعد ذلك؟ وماذا يجب أن يفعل الفلسطينيون وغيرهم؟

تناقش هذه الورقة التحليلية مجموعة من الأسئلة. يتعرض السؤال الأكثر إلحاحا لقدرة إسرائيل على البقاء في قطاع غزة وتوطيد احتلاله بالنظر إلى النتيجة الأكثر ترجيحا المتمثلة في مواجهته لمقاومة مسلحة على الفور. في مواجهة ذلك، هل سيبقى الجيش الإسرائيلي وإلى متى؟ وإذا بقي، فهل سيتحمل مسؤولية تقديم الخدمات المدنية للسكان أم ستقنع إسرائيل الآخرين، بما في ذلك الجهات الفاعلة الدولية والإقليمية، أو حتى السلطة الفلسطينية، بالقيام بذلك بدلا منها؟ وبديلا من ذلك، هل ستنسحب من جانب واحد مما سيخلق فراغا يتيح لجميع اللاعبين، بما في ذلك حماس، ملؤه؟ أم أنها ستنسحب، جزئيا أو كليا، كجزء من ترتيبات سياسية وأمنية جديدة؟ ما نوع الترتيبات التي ستكون قابلة للتطبيق بما يكفي لتحقيق نتيجة مستدامة؟ وفي هذا السياق، ما هو الدور الذي ينبغي أن يلعبه المجتمع الدولي ومن قد يكون الشريك الفلسطيني لإسرائيل في تحقيق هذه النتيجة؟

في غضون ذلك، ما الذي قد يحدث للسلطة الفلسطينية وسيطرتها في الضفة الغربية؟ هل ستتطور الاشتباكات المسلحة المحدودة الحالية وعنف المستوطنين في الضفة الغربية إلى اندلاع أعمال عنف واسعة النطاق؟ وإذا حدث ذلك، هل ستقف قوات الأمن التابعة للسلطة الفلسطينية جانبا، أم تنضم إلى الاشتباكات المسلحة، أم تختار بدلا من ذلك الحفاظ على خيار التنسيق الأمني؟ إذا نجت السلطة الفلسطينية من الهجوم الحالي على قطاع غزة دون الكثير من الأضرار، وإذا وضع المجتمع الدولي ترتيبات سياسية مستدامة على الطاولة في مرحلة ما في المستقبل القريب، مهما كان ذلك غير مرجح، فما المطلوب من السلطة الفلسطينية أن تفعل لجعل نفسها مقبولة لدى شعبها ولاعبا شرعيا جديا لدى الآخرين، لاعب يمكنه أن يسهم في استعادة الحكم، بما في ذلك فرض النظام والقانون، والعوة إلى قطاع غزة؟

 

خلفية:

في إطار جهودها لإنهاء الوضع المعلق والمتقلب الذي وجد قطاع غزة نفسه فيه منذ عام 2007 ولجعل القطاع أكثر استقرارا وسيطرتها عليه أكثر استدامة على المدى الطويل، شنت حماس هجوما مسلحا واسع النطاق على إسرائيل على أمل جلبها إلى طاولة المفاوضات. في حين أن حماس ربما كانت تأمل، كنتيجة لهذا الهجوم، في التفاوض مع إسرائيل على ترتيبات طويلة المدى لقطاع غزة تخلصه من الحصار والإغلاق، فإن النجاح العسكري الهائل لهجوم 7 أكتوبر، والمشاهد الواسعة النطاق للقتلى المدنيين الإسرائيليين الذي صوره مقاتلو حماس أنفسهم وأطراف أخرى، واحتجاز العديد من الرهائن المدنيين، بمن فيهم النساء والأطفال، خلق واقعا مختلفا تماما ربما لم تتوقعه حماس. إن المفاجأة والصدمة والغضب في إسرائيل وفي العديد من البلدان الغربية قدم للحكومة الحالية الأكثر تطرفا في تاريخ ذلك البلد التعاطف الضروري والدعم، الذي لا يرقى إليه الشك، لأهدافها المتمثلة في القضاء على حماس حتى لو كان ذلك يعني تدمير أجزاء واسعة من قطاع غزة وإلحاق نكبة ثانية بسكانه المدنيين. لقد قدم العالم الغربي لإسرائيل الدعم العسكري والسياسي والمعنوي للتسبب المتعمد بقدر هائل من المعاناة الإنسانية لسكان غزة مما أدى إلى مستوى من إراقة دماء المدنيين لم يسبق له مثيل في جميع الصراعات الفلسطينية-الإسرائيلية.

غني عن القول إن مصلحة حماس في ضمان بقائها والمستوى غير المسبوق من الدمار ومشاهد وأعداد القتلى المدنيين الفلسطينيين من النساء والأطفال ستولد التصميم والغضب الشعبي الهائل وستخلق بحرا من مطالب الانتقام حتى لو جاء بأبشع الصور. سيضمن ذلك استمرار مقاومة مسلحة شديدة وستبدو الحرب بلا نهاية. وستجد إسرائيل نفسها تعزز احتلالها يوما بعد يوم بينما تسعى إلى التوصل إلى ترتيب سياسي يسمح بتقديم الخدمات الإنسانية والخدماتية وغيرها مع الحفاظ على سيطرتها العسكرية العليا على القطاع بأكمله. ومع ذلك، لن يكون هذا الوضع قابلا للحياة لأن الخسائر الإسرائيلية ستكون في ازدياد، ومن المحتمل أن تستمر الظروف الإنسانية في التدهور على الرغم من الجهود التي تبذلها المنظمات الدولية، مثل الأونروا وغيرها. وبالنظر إلى موقف إسرائيل المعلن بأنها ستواصل إلى أجل غير مسمى السيطرة الأمنية الشاملة على قطاع غزة، سيكون من المستحيل على أي هيئة إقليمية أو دولية الموافقة على الإحلال مكان الجيش الإسرائيلي في أي جزء من الأراضي المحتلة. وبالمثل، يستحيل على السلطة الفلسطينية في هذا السياق أن تستأنف تقديم أي خدمات جوهرية، ناهيك عن القيام بأي دور في إنفاذ القانون.

 

لمن ستكون السيطرة؟

في ظل هذه الظروف، سيتعين على إسرائيل أن تقرر ما إذا كانت ستبقى أو تنسحب من القطاع أو أجزاء منه. وإذا قررت البقاء، فإنها ستتعرض لضغوط من الجماعات اليمينية المشاركة في الائتلاف الحاكم الراهن لإعادة بناء المشروع الاستيطاني السابق في غزة، وفي الوقت نفسه ستجد نفسها مضطرة إلى تقديم المزيد والمزيد من الخدمات إلى 2.3 مليون فلسطيني في بيئة يكون فيها الاقتصاد والبنية التحتية الأساسية مهدمين تماما بالإضافة إلى تدمير عشرات الآلاف من المنازل ومئات المدارس والعديد من المستشفيات. سيتعين على الجيش الإسرائيلي أن يكرس أجزاءً من قواته لإدارة الحياة المدنية، ولكن دون أن يكون قادرا على فرض النظام والقانون. في حين أنه من الصعب اليوم رؤية إمكانية إعادة بناء المستوطنات الإسرائيلية في غزة، فإن ديناميكيات السياسة الداخلية الإسرائيلية، في بيئة من الاحتلال طويل الأمد، قد تضع هذه القضية على طاولة المساومة الداخلية الحزبية.

تحت ضغط الخسائر اليومية والرغبة في تجنب وضع تضطر فيه، كقوة احتلال، إلى تقديم الخدمات للسكان المدنيين، قد تقرر الحكومة الإسرائيلية الانسحاب من معظم قطاع غزة من جانب واحد وبشكل تدريجي. إن هذه النتيجة رغم أنها مستبعدة اليوم إلى حد كبير، فإنه في ظل غياب شركاء على استعداد لقبول شروط إسرائيل لترتيبات ما بعد الحرب، قد تقرر البدء بهذا الانسحاب التدريجي على أمل ظهور مقدمي خدمات محليين أو إقليميين أو دوليين، حتى لو كان ذلك تحت المسؤولية الفعلية لحماس.  بطبيعة الحال، سوف تملأ حماس الفراغ، وعاجلا أم آجلا، لن يكون أمام إسرائيل خيار سوى التفاوض غير المباشر معها من أجل ترتيبات قصيرة أو طويلة الأجل. وغني عن القول إن التوصل إلى اتفاق صريح مع حماس هو أمر لن تتمكن أي حكومة إسرائيلية من إبرامه قريبا. ومع ذلك، فإن الميزة التي تعود على إسرائيل في مثل هذه النتيجة هي أنها تعفيها من الاضطرار إلى إعطاء إجابات على أسئلة صعبة حول مستقبل احتلالها للأراضي الفلسطينية، كما نرى أدناه.

بدون ترتيبات ضمنية مع حماس، قد تجد إسرائيل شركاء غيرها على استعداد للمشاركة في عملية تؤدي إلى ترتيبات طويلة الأجل متفق عليها. هذه النتيجة ممكنة في ظل ظروف معينة، كما نناقش أدناه. لكن من الصعب للغاية أن نرى كيف سيتبلور هذا الأمر في ظل مقاومة مسلحة تقودها حماس، ما لم يتم تنسيق هذه النتيجة مع تلك المقاومة. كذلك، من الصعب أن نرى جدوى مثل هذا الترتيب طويل الأجل إذا لم يكن جزءا من حل أكبر للصراع الفلسطيني-الإسرائيلي، حل ينهي أكثر من خمسة عقود من الاحتلال الإسرائيلي. على سبيل المثال، إن من سيحل محل الجيش الإسرائيلي سيرغب بالتأكيد في معرفة إجابات لثلاثة أسئلة: مصدر سلطته، والترتيبات النهائية، ومدة إقامته. لن يوافق أي من اللاعبين الدوليين أو الإقليميين على استمداد سلطتهم من قوة الاحتلال، وستجد إسرائيل صعوبة في القبول بالأمم المتحدة أو طرف ثالث كمصدر لهذه السلطة . علاوة على ذلك، من المؤكد أن الحكومة الإسرائيلية الحالية ليست مهتمة بتحديد الترتيبات النهائية، وبالتالي، ستنظر إلى الترتيبات على أنها أمر واقع والمدة غير محددة.

 

سيطرة السلطة الفلسطينية؟

إن الجهة الوحيدة التي ستوافق على تولي السيطرة على قطاع غزة دون الكثير من الخلاف حول مصدر السلطة أو مدة مهمتها هي تلك التي تدعي بالفعل السيادة أو السيطرة الرسمية، حتى لو كانت تلك السيطرة اليوم إسمية ، أي السلطة الفلسطينية. في الواقع، بخلاف حماس، ليس لإسرائيل شريك آخر إلا السلطة الفلسطينية. هناك مزايا أخرى، لجميع الأطراف المعنية، لشراكة إسرائيلية مع السلطة الفلسطينية. فهي تقدم بالفعل العديد من الخدمات لسكان غزة، وهي طرف في اتفاقات أوسلو والترتيبات الضمنية التي تم التوصل إليها في عام 2005، في أعقاب الانسحاب الإسرائيلي أحادي الجانب من قطاع غزة، وكل هذه الأمور لا تزال سارية المفعول بشكل مثير للدهشة، حتى وإن كان إلى درجة محدودة، في تنظيم العلاقات الإسرائيلية-الفلسطينية حتى يومنا هذا.

ومع ذلك، ستصر السلطة الفلسطينية أيضا على وضوح الترتيبات النهائية، كما فعلت بالفعل.  ويتطلب هذا الشرط إحياء حل الدولتين، ووضع خطة لما يعنيه ذلك من تفاصيل، وخارطة طريق لكيفية الوصول إليه، وتجديد لمسار دبلوماسي فاعل ومفاوضات فلسطينية إسرائيلية ثنائية مباشرة. غني عن القول أن الحكومة الإسرائيلية الحالية ليست على استعداد للتفكير في مثل هذه الترتيبات النهائية. وقد يفسِر هذا الاستنتاج حقيقة عدم تقدم الولايات المتحدة، أو أي جهة دولية فاعلة أخرى، برؤية لهذه الترتيبات.

ومع ذلك، حتى لو وافقت حكومة إسرائيلية منتخبة حديثا على مناقشة مثل هذه الرؤية، فإن القيادة الحالية للسلطة الفلسطينية تفتقر إلى الشرعية في الضفة الغربية، ناهيك عن قطاع غزة. تواجه السلطة الفلسطينية بالفعل صعوبات في إدارة الضفة الغربية. لو جرت انتخابات رئاسية في اليوم الأخير قبل اندلاع حرب 7 أكتوبر بحيث تنافس فيها ثلاثة مرشحين، هم مروان البرغوثي من فتح واسماعيل هنية من حماس والرئيس محمود عباس من فتح أيضا، فإن 6٪ فقط من سكان الضفة الغربية يقولون إنهم سيصوتون للرئيس الحالي. في نفس الاستطلاع الذي أجراه المركز الفلسطيني للبحوث السياسية والمسحية للدورة الثامنة من الباروميتر العربي الفلسطيني خلال الأسبوع الأخير قبل بدء الحرب الحالية، طالب 85٪ من سكان الضفة الغربية باستقالة رئيس السلطة الفلسطينية.[1] وفي استطلاع أجراه المركز الفلسطيني للبحوث السياسية والمسحية حول تخوفات الجمهور الفلسطيني من إرهاب المستوطنين في الضفة الغربية قبل وأثناء الحرب الحالية، فضل حوالي نصف سكان الضفة الغربية تشكيل مجموعات مسلحة باعتبارها الوسيلة الأكثر فعالية لحمايتهم من عنف المستوطنين. واختار حوالي الخمس فقط نشر شرطة السلطة الفلسطينية وفضل خمس آخر الحماية من الجيش الإسرائيلي.[2]  وفي الواقع، أظهر استطلاع الباروميتر المشار إليه أعلاه أن ثلثي سكان الضفة الغربية يعتقدون أن السلطة الفلسطينية تشكل عبئا على الشعب الفلسطيني. 

علاوة على ذلك، فإن الضفة الغربية تغلي ويمكن أن تندلع فيها أعمال عنف واسعة النطاق في ظل وضع تفقد فيه أجهزة الأمن التابعة للسلطة الفلسطينية المزيد من السيطرة على الأرض. ومع استمرار إسرائيل في إضعاف السلطة الفلسطينية سياسيا وماليا، قد يؤدي المزيد من الضغط إلى تمرد في صفوف القطاع الأمني. وقد وجد بعض الأفراد الذين تربطهم صلات عائلية بالمجموعات المسلحة في الأجزاء الشمالية من الضفة الغربية أنفسهم يقفون إلى جانب أفراد أسرهم ويتركون وظائفهم. ويمكن أن يؤدي توسع انتشار المجموعات المسلحة إلى مناطق أخرى إلى مزيد من الانقسامات داخل قوات الأمن. وبالمثل، يمكن أن يؤدي التململ الراهن داخل حركة فتح ومنظمتها الشبابية، التنظيم، إلى تطرف كبير يؤدي إلى اشتباكات مع الأجهزة الأمنية واحتمال حدوث انفجار داخلي. إن الانفجار في الضفة الغربية سيفتح جبهة عسكرية أخرى ضد إسرائيل وسيتطلب نقل القوات من جبهة غزة إلى جبهة الضفة الغربية. 

 

هل هناك طريق بديل؟

يمكن لإسرائيل والمجتمع الدولي تعزيز السلطة الفلسطينية واستباق هذه النتيجة.  وهذا يتطلب خطوات من إسرائيل. ويمكن أن يشمل ذلك إعادة الموارد المالية المصادرة والمحتجزة للسلطة الفلسطينية، ووقف إرهاب المستوطنين في الضفة الغربية، ووقف التوغلات اليومية للجيش في المدن الفلسطينية، وتسهيل إعادة توحيد الضفة الغربية وقطاع غزة، وتأكيد الالتزام بحل الدولتين ووقف التوسع الاستيطاني، ونقل أجزاء من المنطقة (ج) إلى سيطرة السلطة الفلسطينية، والاتفاق على استئناف المفاوضات مع منظمة التحرير الفلسطينية للتوصل إلى اتفاق دائم. من الواضح أن إسرائيل غير راغبة في القيام بأي مما سبق لأن الحكومة الإسرائيلية الحالية تتكون من متطرفين يمينيين يسعون في الواقع إلى إضعاف السلطة الفلسطينية أكثر وأكثر من أجل فتح الباب على مصراعيه لضم أجزاء من الضفة الغربية أو كلها لإسرائيل.

وحده المجتمع الدولي، بقيادة الولايات المتحدة، يمكنه، من الناحية النظرية، تحديد الخطوط العريضة للخطة المشار إليها أعلاه. وإذا كان الأمر كذلك، فينبغي لها أن تدمجها في رؤية السلام الإقليمي في سياق مبادرة السلام العربية، التي تنص على التطبيع العربي-الإسرائيلي الذي يشكل فيه السلام الفلسطيني-الإسرائيلي على أساس حل الدولتين مكونا مركزيا. تحتاج هذه الرؤية لصياغة خارطة طريق للوصول إلى هناك تأخذ بعين الاعتبار الخطوات الفورية المطلوبة المذكورة أعلاه لتقوية السلطة الفلسطينية. غني عن القول أنه لا يوجد دليل في الوقت الراهن على أن الولايات المتحدة تفكر في إجراء مثل هذا التغيير المعلن في سياستها الحالية تجاه الصراع العربي-الإسرائيلي. 

ومع ذلك، وحتى في أفضل السيناريوهات التي يقدم فيها المجتمع الدولي الرؤية وخارطة الطريق هذه وتوافق حكومة إسرائيلية جديدة، تحت ضغط من الولايات المتحدة والقوى الإقليمية الكبرى، على تعزيز السلطة الفلسطينية وإحياء حل الدولتين، فإن السلطة الفلسطينية الحالية، بسبب افتقارها إلى الشرعية والمصداقية في نظر شعبها، ليست في وضع يمكنها من أن تكون لاعبا ذي مصداقية عند أحد.  ولكن يمكن في الواقع جعلها كذلك في ظل الظروف المنصوص عليها أعلاه.

إذا نجت السلطة الفلسطينية من الهجوم الحالي على قطاع غزة دون الكثير من الأضرار، وإذا تم وضع ترتيبات سياسية جديدة مستدامة على الطاولة في مرحلة ما في المستقبل القريب، على الرغم من أن ذلك قد يكون غير مرجح أبدا، فما هو المطلوب من السلطة الفلسطينية أن تفعل لتعطي نفسها الشرعية في نظر شعبها وتحولها للاعب فاعل في نظر المنطقة والمجتمع الدولي، لاعب يمكنه أن يساعد في استعادة السيطرة والاستقرار لقطاع غزة ، بما في ذلك حفظ الأمن وفرض النظام والقانون، وتكون في الوقت ذاته بمثابة القابلة لإقامة دولة فلسطينية؟

في ظل هذه الظروف، سيجد الفلسطينيون أنفسهم في مواجهة أصعب تحديين حاليين: أولا، كيفية بلورة قيادة سياسية شرعية مقبولة من جميع الفلسطينيين في الضفة الغربية وقطاع غزة، وثانيا، كيفية إعادة توحيد الضفة الغربية وقطاع غزة في نظام سياسي ديمقراطي واحد.  من نافلة القول إن القيادة الحالية للسلطة الفلسطينية خذلت الفلسطينيين في معالجة هاتين المسألتين. وبالمثل، يجب مواجهة الظروف التي أدت إلى الموجة الحالية من العنف غير المسبوق ومعالجتها. الفلسطينيون وحدهم هم القادرون على تغيير قيادتهم. وهم وحدهم القادرون على بناء نظام سياسي ديمقراطي. وهم وحدهم القادرون على بدء عملية حساب داخلية لمنع الدمار الحالي في غزة من الحدوث مرة أخرى أو من الحدوث في الضفة الغربية. الدرس المستفاد من العقود القليلة الماضية في التجربة الفلسطينية وفي المنطقة بأسرها هو أنه لا يمكن لأحد أن يفرض بنجاح تغيير النظام على الآخرين. 

إن الخطوات التي ينبغي للفلسطينيين اتخاذها في السياق الموصوف أعلاه تبدأ بدمج جميع القوى السياسية الفلسطينية في عملية سياسية رسمية، عملية تتمثل رؤيتها في بناء مؤسسات سياسية قوية وخاضعة للمساءلة، مع التمتع بالاحتكار الكامل للقوة المسلحة، أي بناء نظام سياسي ديمقراطي. وينبغي أن تسمح هذه العملية بإعادة حماس إلى العملية السياسية الرسمية للسلطة الفلسطينية مع القبول باحتكار السلطة الفلسطينية للقوة القسرية. وينبغي أن يتبع ذلك تشكيل قيادة وحكومة انتقاليتين غير سياسيتين متفق عليهما، لا يستمدان أي شرعية من رئيس السلطة الفلسطينية ولا تقدمان تقاريرهما له. في هذه الحكومة التكنوقراطية التي تمثل وجوها مقبولة من المجتمع الفلسطيني وقواه السياسية كافة، بما في ذلك حماس، يجب منح رئيس الوزراء الصلاحيات الكاملة للمنصب كما هو منصوص عليه في القانون الأساسي المعدل الحالي، في حين يجب أن تكون صلاحيات الرئيس متسقة مع القانون الأساسي المعدل نفسه ولكن بدون التدخل بعمله كرئيس لمنظمة التحرير الفلسطينية، وذلك بانتظار إصلاح هذه المؤسسة المشلولة وشبه الميتة.

يجب أن تكون المهام الأكثر إلحاحا للقيادة الانتقالية هي إعادة بناء نظام سياسي فلسطيني ديمقراطي حقا. يجب إحياء القضاء كسلطة مستقلة، ويجب استعادة حرية التعبير، ويجب مساءلة الشرطة والأجهزة الأمنية المماثلة أمام رئيس الوزراء، ويجب توسيع المساحة المتاحة للمجتمع المدني بشكل كبير، ويجب تعليق جميع المراسيم بقوانين المثيرة للجدل الصادرة عن الرئيس الفلسطيني التي همشت القضاء على مدى العقد الماضي، وحلت المجلس التشريعي، وأقامت محكمة دستورية صورية، ودمرت الحريات وتعددية المجتمع المدني. وفي غضون عام، يجب أن توافق جميع المجموعات المسلحة، بما فيها تلك التابعة لحماس، على نزع سلاحها وقبول الاندماج في قطاع الأمن الفلسطيني. بعدها يجب على الفلسطينيين إجراء انتخابات رئاسية وبرلمانية في غضون عام أو عامين بعد تشكيل القيادة الانتقالية بحيث تشارك فيها جميع الفصائل. يجب أن يكون قبول العملية الديمقراطية، والانتقال السلمي للسلطة، واحتكار السلطة الفلسطينية للقوة المسلحة هي الشروط السياسية المسبقة الوحيدة للمشاركة.

The Palestinian people confront one of the most difficult challenges they have faced since the 1967 occupation of the Palestinian territories of the West Bank and the Gaza Strip. Given Israel’s declared twin objectives in its current invasion, to destroy Hamas' military capabilities and prevent its return to govern, the reoccupation of parts or the entire Gaza Strip is all but inevitable. An explicit or implicit softening of Israel’s goals, highly unlikely at this time, could significantly change this inevitability by opening the door, in the short term, for a ceasefire agreement, and in the long term, for future indirect negotiation between Hamas and Israel on possible long-term arrangements for the future of the Gaza Strip. If Israel’s current goals do not change, the war will continue for a long time and the Israeli tanks will reach all parts of the Gaza Strip. If so, what happens next? What should the Palestinians and others do?

The following are some of the questions that this Brief addresses. The most immediate question must address Israel’s ability to stay and consolidate that occupation given the most likely outcome that an armed insurgency will be immediately encountered. Facing that, would the Israeli army stay and for how long? If it stays, would it assume responsibility for civilian service delivery to the population or convince others, including international and regional players, or even the PA, to do that instead? Alternatively, would it unilaterally withdraw thereby creating a vacuum for all players, including Hamas, to fill? Or would it withdraw, in part or full, as part of new political and security arrangements? What kind of arrangements would be viable enough to produce a sustainable outcome? In this context what role should the international community play and who might be Israel’s Palestinian partner for such outcome?

In the meanwhile, what is likely to happen to the Palestinian Authority (PA) and its control in the West Bank? Would the current West Bank limited armed clashes and the settlers’ violence lead to a large-scale violent eruption? If that happens, would the PA security forces stand on the sideline, join the armed clashes, or alternatively opt for maintaining security coordination? If the PA survives the current onslaught on the Gaza Strip without too much damage, and if new sustainable political arrangements are put at the table by the international community at one point in the near future, unlikely as that might be, what would be required from the PA to do to make itself acceptable to its own people and a viable player to others, one that can help restore governance, including law enforcement, to the Gaza Strip?

 

Background:

In its effort to end the limbo status in which the Gaza Strip found itself in since 2007 and make its control over it more sustainable in the long term, Hamas launched a massive armed attack on Israel in the hope of bringing it to the negotiating table. While Hamas might have hoped to negotiate with Israel a long-term arrangement for Gaza, one free of siege and blockade, the huge military success of the October 7 attack, the widespread scenes of great civilian killing that was committed by the fighters form Hamas and other groups, and the taking of many civilian hostages, including women and children, created a completely different reality that Hamas might not have anticipated. The rage in Israel and in many other countries provided the current most extreme government in that country’s history with the necessary sympathy and unquestionable support for its goals of eradicating Hamas even if that meant destroying large parts of the Gaza Strip and inflicting a second Nakba on its civilian population. It gave it the political and moral support for the deliberate infliction of a great deal of human suffering on Gazans leading to a level of civilian bloodshed unseen before in all Palestinian-Israeli conflicts.

It goes without saying that Hamas’ interest in ensuring its survival and the scenes and magnitude of the unprecedented level of Palestinian civilian deaths and destruction will generate determination and massive public anger and demands for revenge. This will ensure the continuation of a stiff armed resistance and the war will seem unending. Israel will find itself consolidating its occupation while seeking a political arrangement that would allow the delivery of humanitarian and other services while keeping its military control over the entire Strip. This, however, will not be a sustainable outcome as Israel’s casualties will be on the rise and the humanitarian conditions will probably continue to worsen despite the efforts of international organizations, such as UNRWA and others. Given, Israel’s declared position that it will continue to indefinitely maintain an overall security control over the Gaza Strip, it will be impossible for any regional or international body to agree to replace the Israeli army in any part of the occupied territories. Similarly, it is impossible for the PA in this context to resume any substantial service delivery, let alone have any law enforcement role.

 

Who will be in control?

Under these conditions, Israel will have to decide whether to stay or leave. If it decides to stay, it could come under pressure from its own right wing groups to rebuild the previous Gazan settlement enterprise and at the same time it will find itself pushed into more and more service delivery to 2.3 million Palestinians in an environment in which the economy and the basic infrastructure are in total disrepair on top of the destruction of tens of thousands of home, dozens of schools, and many hospitals. The Israeli army will have to devote part of its forces to the management of the civilian life but without being able to enforce law and order. While it would be difficult today to see the rebuilding of Israel’s pre 2005 Gaza settlements, the dynamics of Israeli domestic politics, in an environment of a prolonged occupation, might force this issue to become part of the domestic bargaining process.

Alternatively, under pressure of daily casualties and the desire to avoid a situation in which it would be forced, as an occupying power, to deliver services to the civilian population, the Israeli government might decide to withdraw from most of the Gaza Strip unilaterally and gradually. This outcome is highly unlikely, but in the absence of partners willing to accept Israel’s conditions for a change in the status quo, it might decide to begin such a gradual withdrawal in the hope that local, regional, or international service delivery providers might emerge, even if under Hamas’ overall responsibility.  Naturally, Hamas will fill the vacuum and, sooner or later, Israel will have no choice but to arrive to the conclusion that it needs to reach short- or long-term de facto arrangements with that organization. The advantage to Israel in such an outcome is that it relieves it from having to come up with answers to difficult questions about the future of its occupation of the Palestinian territories, as we see below.

Without a de facto arrangement with Hamas, Israel might find non-Hamas partners willing to engage it in a process leading to agreed-upon long term arrangements. This outcome is feasible under certain conditions, as we discuss below. But it is extremely difficult to see how this would unfold while a local insurgency is underway, that is, unless that outcome is coordinated with that insurgency. Similarly, it is difficult to see the viability of such a long-term arrangement if it is not part of a larger solution to the Palestinian Israeli conflict, one that ends more than five and a half decades of Israeli occupation. For example, whoever replaces the Israeli army will certainly want to know answers to three questions: the source of its authority, the end game, and the duration of its stay. None of the international or regional players will agree to derive their authority from the occupying power and Israel will find it difficult to endorse a UN or a third-party source of authority. Moreover, the current Israeli government is certainly not interested in defining the end game, and therefore, it will view the arrangements as de facto and the duration indefinite.

 

PA in control?

The only body that will agree to assume control over the Gaza Strip without too much quarrel over the source of authority or the duration of its mission is the one that already claims de jure, even if nominal, control over it, i.e., the PA. In fact, other than Hamas, Israel has no other partner. There are other advantages, to all concerned parties, to an Israeli partnership with the PA. It already provides many services to Gazans, and it is a party to the Oslo agreements and the de facto and de jure arrangements reached in 2005, in the wake of the Israeli unilateral withdrawal from the Gaza Strip, and all these, amazingly, continue, more or less, to define Israeli-Palestinian relations to this day.

Nonetheless, the PA too will insist on the clarity of the end game, as indeed it has already done.  This condition requires the revival of the two-state solution, the development of a plan for what it means and a roadmap for how to get there, and the restoration of a viable diplomatic path and direct Palestinian-Israeli negotiations. It goes without saying that the current Israeli government is not willing to contemplate such an end game. This conclusion might explain why neither the US nor any other international actor has stepped forward to provide such end-game clarity.

Yet, even if a newly elected Israeli government agrees to discuss such a vision, the current PA leadership lacks legitimacy in the West Bank, let alone in the Gaza Strip. The PA is already facing difficulties running the West Bank. If presidential elections were held on the last day before the eruption of the October the 7th war, in which three candidates competed, Marwan Barghouti from Fatah, Ismail Haniyyeh from Hamas, and president Mahmoud Abbas, also from Fatah, only 6% of West Bankers say they would vote for the current president. In that same poll, which was conducted by PSR for Wave 8 of Palestine’s Arab Barometer (AB-8) during the last week before the current war started, 85% of West Bankers demanded the resignation of the PA president.[1] In a PSR survey on public threat perception of settler terrorism conducted in the West Bank before and during the current war, about half of the West Bankers favored the formation of armed groups as the most effective means of protecting their communities from settlers’ violence; about a fifth picked the deployment of the PA police and another fifth favored protection from the Israeli army.[2]  Indeed, PSR’s AB-8 poll showed that two thirds of West Bankers believed that the PA is a burden on the Palestinian people. 

Moreover, the West Bank is boiling and could erupt into widescale violence if and when the PA security services lose further control on the ground. As Israel continues to weaken the PA politically and financially, further squeeze could lead to a mutiny in the security sector ranks. Already individuals with family links to armed groups in the northern parts of the West Bank have found themselves siding with their family members and leaving their services. An expansion of the armed groups to other locations could produce further fractures within the security forces. Similarly, dissent within Fatah and its youth organization, the Tanzim, could bring about significant radicalization leading to clashes with the security services and the possibility of an internal implosion. An explosion in the West Bank could open another military front against Israel and might require moving forces from the Gaza front to that of the West Bank. 

 

Is there a way forward?

Israel and the international community could strengthen the PA and preempt such outcome.  This requires steps from Israel. These could include returning confiscated and withheld PA financial resources to the PA, stopping settler terrorism in the West Bank, stopping the army’s daily incursions in Palestinian cities, facilitate the reunification of the West Bank and the Gaza Strip, assert commitment to the two state solution and stop settlement expansion, transfer parts of area C to the PA control, and agree to resume negotiations with the PLO for a permanent agreement. Obviously Israel is unwilling to do so because the current Israeli government is made up of right wing extremists who in fact seek to weaken the PA further in order to open the door wide to annexation of parts of or all of the West Bank.

Only the international community, led by the US, can, in theory, outline the plan referred to above. If so, it should embed it in a vision for regional peace within the context of the Arab Peace Initiative, one that provides for Arab-Israeli normalization in which Palestinian-Israeli peace along the two-state solution is a central component; and it needs to articulate a roadmap to get there, one that takes into consideration the immediate steps outlined above to strengthen the PA. There is no evidence at this time that the US is contemplating such a declaratory change in its current policy toward the Arab-Israeli conflict. 

Yet, even in the best case scenario in which the international community provides the vision and the road map and a new Israeli government, under pressure from the US and the major regional powers, agrees to strengthen the PA and revive the two state solution, the current PA, due to its lack of legitimacy and credibility in the eyes of the Palestinian people is not in a position to be a viable player.  But it can be made one if the preconditions described above are indeed met.

If the PA survives the current onslaught on the Gaza Strip without too much damage, and if new sustainable political arrangements are put at the table at one point in the near future, unlikely as that might be, what would be required for the PA to do to make itself legitimate in the eyes of its public and a viable player in the eyes of the region and the international community, one that can help restore governance, including law enforcement, to the Gaza Strip and serve as the midwife for Palestinian statehood?

Under these conditions, the Palestinians will find themselves confronting their current two most difficult challenges: first, how to produce a legitimate political leadership acceptable to all Palestinians in the West Bank and the Gaza Strip, and second, how to reunify the West Bank and the Gaza Strip into one democratic political system.  In addressing these two issues, it goes without saying that the current PA leadership has failed the Palestinians. Similarly, the conditions that led to the current wave of unprecedented violence must be confronted and addressed. Only the Palestinians can change their leadership; and only they can build a democratic political system; and only they can begin an internal process of reckoning to prevent the current Gazan devastation from happening again or from happening in the West Bank. The lesson from the past few decades in the Palestinian experience and in the entire region is that no one can successfully impose regime change on other people. 

The steps the Palestinians should take within the context described above begins with the integration of all Palestinian political forces into a formal political process, one whose vision is to build strong and accountable political institutions, while enjoying complete monopoly over coercive force, a democratic political system. This process should allow Hamas to be brought back into the formal PA political process while acknowledging the PA’s monopoly over force. This should be followed by the formation of an agreed upon apolitical transitional leadership and government, one that does not derive any legitimacy from the PA president nor report to him. Indeed, in this technocratic government that represents faces acceptable to all Palestinian factions, including Hamas, the prime minister must be granted the full jurisdiction of the office as stipulated in the Basic Law while the jurisdiction of the president must be consistent with that same Basic Law but without undermining his position as the chairman of the PLO Executive Committee, that paralyzed and dysfunctional body.

The most immediate tasks of the transitional leadership must be the restoration of a truly democratic Palestinian political system. The judiciary must be revived as an independent body, free speech must be restored, the police and similar security services must be made accountable to the prime minister, the space for civil society must be significantly expanded, and all controversial presidential decrees that have over the past decade marginalized the judiciary, dismissed the parliament, destroyed liberties and civil society’s pluralism, and established a politicized constitutional court that rubber stamped other unconstitutional presidential decrees, must be suspended. Within a year, all armed groups, including those of Hamas, must agree to disarm and to accept integration into the Palestinian security sector. Following that, Palestinians must hold presidential and parliamentary elections within a year or two after the formation of the transitional leadership in which all factions participate. Acceptance of the democratic process, the peaceful transition of power, and the PA’s monopoly over coercive force must be the only political preconditions for participation.

 

In Conclusion:

It should be plainly clear that none of the above will be possible without a comprehensive vision for the two-state solution, without a detailed roadmap to reach it, and without a viable negotiating process between Israel and the PLO within an Arab and regional framework based on the Arab Peace Initiative. We are very far from such a development. No regional or international leadership is willing to embrace it and no Israeli partner is willing to accept it. Israel may soon find itself returning to the implicit arrangements that existed with Hamas in the Gaza Strip before October the 7th because it absolves it of providing answers to the difficult questions posed by the alternative. So far, the international community and the regional Arab leadership seem complicit in this outcome.

2) التحديات الرئيسية لإجراء الانتخابات في القدس الشرقية

رفض إسرائيل للتعاون

إن احتمال إجراء أي انتخابات فلسطينية في القدس الشرقية في المستقبل يتضاءل مع استمرار الاحتلال الإسرائيلي وقيامها بضم أجزاء من الضفة الغربية، وكلما تعزز الافتراض بأن الحكومة الاسرائيلية ستتدخل أو تمنع إجراء الانتخابات.  زادت الحكومة الإسرائيلية منذ عام 2006 من توسعها العدواني في القدس الشرقية وتتميز الحكومة المنتخبة مؤخرا، بقيادة بنيامين نتنياهو، بمواقف متطرفة تدعو للمزيد من الضم وتعميق الاحتلال.

في انتخابات عام 2006، أظهرت الحكومة الإسرائيلية عدم رغبتها في السماح بإجراء انتخابات حرة ونزيهة في القدس الشرقية. وحظرت افتتاح مراكز للتصويت والاقتراع، مما أجبر الناخبين على الإدلاء بأصواتهم في مكاتب البريد في القدس حيث كانت الشرطة الإسرائيلية تشرف عليها. وعلى الرغم من أن الأثر الفعلي لهذا السلوك المقيد لحرية التصويت غير مؤكد، فإنه يمكن للمرء أن يفترض أن هذا الإشراف من قبل شرطة الاحتلال خلق جوا عدائيا يثبط المشاركة الديمقراطية. وعلاوة على ذلك، تمت مداهمة جميع مكاتب حماس وإغلاقها، وحرم مرشحو حماس من الإذن بالقيام بحملاتهم الانتخابية.

غياب الثقة بالنظام السياسي

إذا جرت أية انتخابات في القدس الشرقية، فستصعد للسطح مشكلة خطيرة تتعلق بالمشاركة السياسية والإيمان بإمكانية التغيير التشريعي. في استطلاع أجراه المركز الفلسطيني للبحوث السياسية والمسحية في عام 2022، قال 93٪ من سكان القدس الشرقية إنهم لم يشاركوا في الانتخابات الفلسطينية السابقة. وكان العديد من المجيبين أصغر من أن يصوتوا في عام 2006. لكن الأهم من ذلك أن 6٪ فقط قالوا إنهم سيشاركون في انتخابات فلسطينية مستقبلية. هذا انخفاض بمقدار 33 نقطة مئوية عن نسبة الذين قالوا من بين سكان القدس الشرقية إنهم سيشاركون في استطلاع للمركز نفسه في عام 2010. وحقيقة أن هذه المشكلة قد تفاقمت على مدى عقد من الزمان تظهر استياء متزايدا من السلطة الفلسطينية. كانت هناك زيادة بمقدار 22 نقطة في التصور بأن السياسيين غير مؤثرين ولا يمكنهم مساعدة سكان القدس الشرقية.[7] من المعقول أن نفترض أن تأجيل الانتخابات في عام 2021 لم يؤد إلا إلى زيادة هذه المخاوف.

من المهم الإشارة إلى أن الانخفاض في الدافعية للمشاركة لا يقابله ارتفاع مماثل في نسبة الاعتقاد بفائدة الانتخابات الإسرائيلية، حيث أن لهذه الانتخابات مستويات مشاركة مماثلة (95٪ من المستطلعين قالوا إنهم لم يشاركوا في انتخابات الكنيست أو الانتخابات البلدية). ومع ذلك، من المهم الإشارة إلى أن هناك انخفاض بمقدار 12 نقطة في نسبة سكان القدس الشرقية الذين يؤكدون على مقاطعة الانتخابات البلدية أو انتخابات الكنيست الإسرائيلية على أساس أن الاحتلال يجعل هذه السلطة غير شرعية.[8] قد لا يعني هذا أن هؤلاء المستطلعين ينظرون الآن إلى السلطة الإسرائيلية على أنها شرعية، بل يمكن أن يشير إلى انهيار الاعتقاد بأن المقاطعة جديرة بالاهتمام أو فعالة وتعزيز فكرة أن سكان القدس الشرقية يجب أن يحاولوا جعل الأمور تعمل في ظل الاحتلال الحالي.

وإلى جانب الانخفاض في عدد المشاركين الذين قاطعوا الانتخابات بسبب الاحتلال، هناك انخفاض مقابل في عدد المستطلعين الذين كانوا على استعداد للتصويت في الانتخابات الإسرائيلية في حال طلبت السلطة الفلسطينية منهم ذلك. في عام 2010، قال 23٪ من المستجيبين إنهم سينفذون الطلب.  أما في عام 2022 ، فقال ذلك 3٪ فقط،[9] وهذا يشير إلى انهيار كبير في مكانة السلطة الفلسطينية في القدس الشرقية.

وإذا افترضنا أن هذه الاتجاهات ستتأكد في حال إجراء انتخابات رئاسية أو تشريعية في المستقبل القريب، فإن نسبة إقبال أقل من 10 في المائة في القدس الشرقية ستضر بشكل لا يصدق بشرعية السلطة الفلسطينية أو الرئيس المنتخب حديثا. لذلك من الضروري محاولة معالجة مثل هذه المخاوف قبل الانتخابات.

في ظروف مثالية، مثلا في حال خففت فيه الحكومة الإسرائيلية قيود الاحتلال المشددة وسمحت بإجراء الانتخابات، من المرجح أن يخفف ذلك من الرأي القائل بأن مسؤولي السلطة الفلسطينية لا يستطيعون مساعدة القدس الشرقية. ومع ذلك، فإن احتمال حدوث ذلك ضئيل.  وثمة عامل آخر هو عدم قدرة المرشحين على الوصول إلى سكان القدس الشرقية لأن إسرائيل لن تسمح لهم بالقيام بحملة انتخابية هناك. وبالتالي، فإن التأثير المحتمل لهذه الانتخابات وهؤلاء المرشحين على القدس الشرقية كدائرة انتخابية يبقى غير واقعي وغير مؤكد بالنسبة لسكان القدس الشرقية.  لا يمكن معرفة ما إذا كان سيتم الاستماع إلى هذه المخاوف أم لا. ومن المرجح أن القضايا المتعلقة بجودة المرشحين لا يمكن تغييرها بشكل جاد إلا بمرور الوقت والانتخابات المتتالية حيث يثبت المسؤولون أنفسهم للناخبين على أنهم جديرون بالثقة وقادرون على إجراء تحسينات ذات مغزى في حياة سكان القدس الشرقية.

 

عقبات أخرى أمام المشاركة السياسية

بصرف النظر عن التدخل الإسرائيلي وعدم الثقة بالنظام السياسي الفلسطيني، هناك مشاكل إضافية – مرتبطة إلى حد كبير باحتلال القدس الشرقية –يمكن أن تقوض المشاركة السياسية في الانتخابات.

يواجه سكان القدس الشرقية انتهاكات يومية لحقوقهم في حرية التنقل والتعبير والتعليم. هذه أداة قوية للحكومة الإسرائيلية لإحداث تقليص تدريجي على شعور الفلسطينيين بالهوية وتقرير المصير والحرية. إن التأثير التراكمي لذلك في النظام الديمقراطي مدمر بشكل لا يصدق حيث يستسلم الناخبون لقبول الاضطهاد، أو على الأقل لأن يتعبوا من الاحتجاج - على اضطهادهم.

كما تم تقييد التعليم وتعطيله من قبل الاحتلال، مع فرض رقابة خاصة على المواد التعليمية التي تشير إلى الهوية الوطنية الفلسطينية. وهذا يشكل مشكلة للمشاركة السياسية إذ من الذي سيغرس في الأطفال الشعور بالمسؤولية المدنية للمشاركة في العمليات الديمقراطية.

ويشكل تقييد حرية التنقل تحديا خاصا. فحتى لو سمح بالتصويت المحدود في مكاتب البريد، على سبيل المثال، فإن هذا سيقتصر بشكل أكبر على أولئك الذين يمكنهم أخذ إجازة من العمل للسفر ولديهم الوسائل للقيام بذلك.

 

3) الخيارات السياساتية:

في ضوء التحديات الحرجة آنفة الذكر، هناك العديد من الخيارات المتاحة لواضعي السياسات للنظر فيها:

 

تأجيل الانتخابات لأجل غير مسمى:

الخيار الأول الذي يجب النظر فيه هو استمرار الوضع الراهن، أي تأجيل الانتخابات التشريعية والرئاسية إلى أجل غير مسمى، حتى يمكن ضمان إجراء الانتخابات في القدس الشرقية دون تدخل إسرائيلي كبير.

يجب تجنب هذا الخيار بأي ثمن. إن. التبرير الرئيسي لهذا الخيار هو أنه في إجراء الانتخابات من دون القدس الشرقية، ستكون السلطة الفلسطينية، أو يمكن أن تفهم على أنها تقبل ضمنيا الاحتلال الإسرائيلي غير القانوني وتتخلى عن حقوق سكان القدس الشرقية.

ومع ذلك، فإن السلطة الفلسطينية، باتخاذها موقفا ضد التدخل الإسرائيلي، تضمن استمرار حرمان بقية الناخبين الفلسطينيين من حقهم في تقرير المصير والمشاركة في الانتخابات. تأثير هذا يمكن أن يكون كارثيا. لقد فازت حماس بالفعل في الانتخابات السابقة للسلطة الفلسطينية ، وتخاطر فتح بتنفير الناخبين منها، وخاصة إذا اعتقدوا أنها تصرفت لما فيه مصلحتها الحزبية الذاتية. وكما قال النقاد بعد التأجيل، يمكن اتهام فتح بالسماح لإسرائيل فعليا باستخدام حق النقض (الفيتو) على الانتخابات الفلسطينية.[10]

علاوة على ذلك، يجب على السلطة الفلسطينية أن تثبت قدرتها على الإدارة الحكومية الفاعلة وعلى الالتزام بالقانون الدولي وإجراء انتخابات منتظمة. وهذا أمر جوهري لتعزيز الدعم الداخلي ضد الاحتلال الإسرائيلي، وتوحيد الفلسطينيين خلف مؤسساتهم الوطنية، ولكن أيضا لحشد الدعم الدولي كدولة قادرة على حكم نفسها وكلاعب مساو لإسرائيل.

وتبقى الحقيقة الأساسية هي أن الانتخابات لم تحدث منذ عام 2006، وأن نسبة كبيرة من الناخبين الفلسطينيين تتراوح أعمارهم اليوم بين 18 و34 عاما، مما يعني أنهم لم يصوتوا أبدا في الانتخابات الفلسطينية. وهذا واقع غير مقبول ولا يضمن إلا استمرار خيبة الأمل السياسية ويضعف شرعية السلطة الفلسطينية وبالتالي يقلل من قدرتها على الحكم.

 

إجراء الانتخابات بدون القدس:

هناك عدة بدائل للتأجيل إلى أجل غير مسمى. الأول هو المضي قدما في كل من الانتخابات التشريعية والرئاسية بغض النظر عما إذا كانت إسرائيل تسمح بإجرائها في القدس الشرقية. كما ذكرنا سابقا، هناك جوانب سلبية واضحة لإجراء هذه الانتخابات مع العلم أن عددا كبيرا من الناخبين لن يتمكنوا على الأرجح من التصويت، ومن المؤسف أن السلطة الفلسطينية يمكن أن ينظر إليها في هذه الحالة على أنها مسؤولة عن حرمان سكانها من التصويت.

ومع ذلك، من الأهمية بمكان أن يتأسس المجلس التشريعي الفلسطيني، وأن يتم انتخاب رئيس بولاية جديدة. إن وجود دليل على أن التصويت قد تم قمعه يمكن أن يوفر للمجلس التشريعي الفلسطيني المنتخب حديثا نقطة انطلاق قوية في وضع أجندة سياسية قوية تقف في وجه العدوان الإسرائيلي. ويمكن اتخاذ إجراءات رمزية لتمثيل الممثلين المفقودين من القدس الشرقية، مثل ترك المقاعد فارغة.

 

إجراء الانتخابات مع القدس:

ثمة خيار آخر لا يتمثل في المضي قدما في الانتخابات فحسب، بل أيضا محاولة إجراء شكل من أشكال التصويت في القدس الشرقية. كان هذا هو الخيار المفضل لحماس في عام 2021. صرحت لجنة الانتخابات المركزية الفلسطينية قبل أيام من قرار عباس أنها تعتقد أن ما يقرب من 150,000 ناخب فلسطيني ممن يحق لهم حق الاقتراع من ضواحي القدس الشرقية (ما يقرب من نصف سكان المدينة الفلسطينيين) لن يحتاجوا لموافقة إسرائيل من أجل أن يتمكنوا من لتصويت.[11] قد تكون هذه فرصة عظيمة لإظهار المقاومة وخاصة إذا حضرت أعداد كبيرة للتصويت على الرغم من التهديدات الإسرائيلية.

ومع ذلك، يمكن أن يكون هذا عملا استفزازيا خطيرا يؤدي إلى العنف في جميع أنحاء القدس وربما في أماكن أخرى. ومن المرجح أن تشهد اعتقالات جماعية لأي شخص يحاول تسهيل الانتخابات في القدس الشرقية. ولن تكون هذه هزيمة نفسية قوية للسلطة الفلسطينية فحسب، بل يمكن أن تزيد أيضا من زعزعة استقرار السلطة الفلسطينية إذا تم اعتقال أعداد كبيرة من المسؤولين، مما يحول دون القدرة التشغيلية للسلطة الفلسطينية.

 

تشجيع الإسرائيليين على التعاون:

بطبيعة الحال، سيكون السيناريو المثالي هو أن تسمح إسرائيل بإجراء تصويت كامل وحر ونزيه في القدس الشرقية. ولتمكين حدوث ذلك، من المرجح أن يتطلب الأمر ضغطا دوليا أقوى بكثير على إسرائيل للسماح بإجراء الانتخابات، والتزاما أكبر من المجتمع الدولي بالدفاع عن حق السكان الفلسطينيين في الديمقراطية. ويمكن أن يتخذ ذلك شكل التزام المجتمع الدولي بالعمل مع السلطة المنتخبة (على الأرجح مع التحذير من أنها يجب أن تلتزم بالقانون الدولي). وربما يكون هذا الالتزام ضروريا لحشد دعم الأطراف الدولية مثل الاتحاد الأوروبي الذي يعتبر حماس جماعة إرهابية. وللحصول على دعم الولايات المتحدة، ربما يتعين إجراء انتخابات عاجلا وليس آجلا بينما لا يزال الديمقراطيون يسيطرون على الرئاسة، حيث من المفترض أن تشهد عودة دونالد ترامب (أو مرشح مماثل) إلى البيت الأبيض موقفا أكثر تأييدا لإسرائيل.

ويتعين على المجتمع الدولي أن يكون واضحا في تحديد العواقب إذا تدخلت إسرائيل في الانتخابات؛ وينبغي تطبيق هذه العقوبات بحزم إذا لزم الأمر. وكما أشار عباس نفسه في خطابه أمام الأمم المتحدة في أيار/مايو 2023 في الذكرى ال75 للنكبة، كان هناك أكثر من ألف قرار للأمم المتحدة بشأن فلسطين ولكن لم يتم تنفيذ أي منها على الإطلاق.[12] وإذا استطاع المجتمع الدولي أن يحدد العواقب ويطبقها، فقد تكون هذه لحظة حاسمة لاستعادة الشعور الفلسطيني بالثقة في المؤسسات الدولية.

يواجه هذا الخيار مشاكل كبيرة تتعلق بمدى واقعيته. لا يستطيع صانعو السياسات الفلسطينيون إجبار الجهات الدولية الفاعلة على اتباع خط العمل هذا. يركز المجتمع الدولي حاليا إلى حد كبير على الحرب في أوكرانيا ولا ينظر إلى فلسطين على أنها أولوية عالية. ومع ذلك، يمكن أن يكون هذا هو المكان الذي يركز فيه المجتمع الدولي جهده في الضغط والدبلوماسية، لأن هذا هو الخيار الأكثر واقعية في أن يجلب تعاونا من إسرائيل.

 

معالجة الدوافع الأخرى لتأجيل الانتخابات:

تستند جميع الخيارات المذكورة أعلاه إلى افتراض أن عباس كان صادقا في تبريره لتأجيل الانتخابات. ومع ذلك، إذا افترضنا أن منتقديه محقون في تسليط الضوء على المخاوف من فوز «حماس» والتحديات المحتملة من داخل «فتح»، فهناك خيارات أكثر جدوى لصانعي القرار للنظر فيها.

لقد اتخذت فتح وحماس بالفعل خطوات لتحسين الأوضاع بينهما. اعتبارا من عام 2022، وافقت جميع الفصائل ال 14 على إجراء انتخابات وطنية في غضون عام.[13]  ووعدت كل من فتح وحماس بأن هذا لن يكون وعدا فارغا آخرا لن يتم الوفاء به، ولكن الوقت وحده سيكون الحكم. يمكن لصانعي القرار أيضا ممارسة الضغط على حماس وأي فصيل آخر يدعو إلى استخدام القوة كأداة سياسية للالتزام باتباع القانون الدولي إذا تم انتخابه.

إن الانقسام الداخلي في حركة فتح ليس شيئا يمكن معالجته مباشرة من قبل صانعي القرار، لكن يمكنهم ممارسة الضغط على فتح لإقناعها بوضع مصلحة البلاد أمام مصلحة الحزب، الأمر الذي قد يجني ثماره.

 

معالجة قضية المشاركة السياسية:

كما هو مبين في بداية هذه الورقة، حتى لو أجريت الانتخابات، فإن السلطة الفلسطينية تواجه تحديا صعبا يتمثل في عدم الرغبة لدى سكان القدس الشرقية في المشاركة السياسية. إن من الصعب على صانعي القرار محاولة معالجة هذا الأمر دون إعطاء وعد ثابت بإجراء الانتخابات في المستقبل. كما أن المشاكل المتعلقة بتقييد الحقوق، لا سيما حرية الحركة والعمل السياسي والتعليم ، صعبة بشكل خاص. ومع ذلك، فإن أحد المجالات التي يمكن معالجتها هو الفساد والثقة في القادة السياسيين. ويمكن لصانعي القرار أن يركزوا طاقاتهم على ضمان قدر أكبر من المسؤولية والمساءلة في الحكومة، وبالتالي بناء الثقة تدريجيا في السياسيين والمؤسسات العامة.

 

4) الخلاصة:

إن احتمال إجراء انتخابات مستقبلية في القدس الشرقية وفلسطين هو احتمال قاتم. تواجه السلطة الفلسطينية الصعوبات في جبهتين منفصلتين: إسرائيل واللامبالاة السياسية، ويجب إزالة كليهما أو معالجتهما من أجل إجراء الانتخابات بنجاح.

على المدى القصير، ينبغي على صانعي القرار أن يركزوا غالبية جهودهم على إقناع حركة «فتح» بإجراء شكل من أشكال الانتخابات في أقرب وقت ممكن، بموافقة إسرائيل أو بدونها. كما أن الضغط على المجتمع الدولي للحصول على دعم أكبر يمكن أن يجني ثماره، على الرغم من أن احتمال حدوث أي تحول كبير في الوضع الراهن ضئيل. وعلى المدى الطويل، يجب على صانعي القرار معالجة اللامبالاة الخطيرة تجاه المشاركة السياسية. إن إجراء الانتخابات من شأنه أن يقلل جزئيا من هذه اللامبالاة، لكنه لن يحلها تماما.

قد تكون هذه اللحظة نقطة تحول في الصراع الفلسطيني الإسرائيلي، ربما بنفس أهمية نقطة التحول تلك التي تبلورت قبل 30 عاما بالضبط وأصبحت تعرف باسم عملية أوسلو. وفي حين أنه من الصعب تقييم النتيجة المستقبلية للديناميات الحالية، إلا أنها لا تبدو جيدة بالنسبة لفلسطين أو إسرائيل. سيتشكل المستقبل القريب عند تصادم تطورين، أحدهما فلسطيني والآخر إسرائيلي. في الجانب الفلسطيني، وصلت السلطة الفلسطينية الآن إلى النقطة التي لم تعد فيها قادرة على تلبية توقعات إسرائيل الأمنية بالكامل في ضمان "احتكار" القوة المسلحة في المناطق الخاضعة لسيطرتها. ويتجلى هذا التطور حاليا في تشكيل جماعات مسلحة يقودها شباب فلسطينيون في المدن ومخيمات اللاجئين، وأبرزها في الجزء الشمالي من الضفة الغربية. علاوة على ذلك، يعتقد الفلسطينيون اعتقادا راسخا أن التكاليف التي فرضت على إسرائيل خلال الانتفاضتين الأولى والثانية هي التي أقنعتها باعتبار الدولة الفلسطينية مصلحة وطنية إسرائيلية. وهذا الاعتقاد بفاعلية القوة هو الذي يغذي الآن صعود الجماعات المسلحة في الضفة الغربية.

على الجانب الإسرائيلي، تظهر "إسرائيل جديدة" تتميز بأيديولوجية قومية دينية حريصة على تحجيم إسرائيل العلمانية التي عرفها الفلسطينيون خلال معظم السنوات الثلاثين الماضية، منذ اتفاق أوسلو، وعلى تأكيد سيطرة إسرائيل الدائمة على الضفة الغربية. إن تشكيل اليمين الحالي، أي القومي والقومي-الديني، والحكومة المتطرفة الراهنة التي تمثله والتي تهيمن عليها لأول مرة في تاريخ إسرائيل أحزاب سياسية دينية وقومية-دينية في الغالب، هو أوضح إشارة حتى الآن على التطور الثاني. تُعيد "إسرائيل الجديدة" الصراع الفلسطيني الإسرائيلي إلى جذوره التاريخية الوجودية.

تستكشف هذه الورقة الظروف التي أدت لتبلور الواقع الراهن والتي يمكن أن تؤدي إلى الاصطدام المتوقع وكيف يمكن للفلسطينيين والإسرائيليين تجنبه. في سيناريو الاصطدام، تستمر السلطة الفلسطينية في فقدان شرعيتها وثقة شعبها، ويزداد ضعفها بسبب التدابير العقابية الإسرائيلية والتوغلات العسكرية المتزايدة في الأراضي الفلسطينية. ويمكن أن يؤدي التأثير المشترك لذلك لانخفاض قدرة السلطة الفلسطينية على فرض النظام والقانون، مما قد يؤدي إلى زيادة الفراغ الأمني في أجزاء من الضفة الغربية وما ينتج عن ذلك من تشكيل جماعات فلسطينية مسلحة جديدة مستعدة لتحدي قوات الأمن التابعة للسلطة الفلسطينية وقوات الجيش الإسرائيلية. وفي الوقت الذي يسعى فيه الجيش الإسرائيلي إلى ملء الفراغ، فإن ذلك السلوك يزيد من إضعاف السلطة الفلسطينية مما يؤدي إلى حلقة مفرغة من العنف وسفك الدماء. كان العام الماضي الأكثر عنفا في العلاقات الفلسطينية الإسرائيلية منذ نهاية الانتفاضة الثانية. ارتفع عدد الاشتباكات المسلحة مع الجيش الإسرائيلي ثلاث مرات على الأقل مقارنة بعام 2021.[1] وبلغ عدد الضحايا الفلسطينيين في الضفة الغربية وحدها 146 شهيدا، وهو أعلى عدد منذ عام 2005.[2] وبلغ عدد القتلى الإسرائيليين 31 قتيلا، وهو أعلى عدد منذ عام 2008.[3] وبلغت حوادث العنف التي ارتكبها المستوطنون ضد الفلسطينيين في العام 2022 وحده 755 حادثة، مقارنة ب 496 حادثا في العام 2021 و358 حادثا في العام 2020.

يمكن أن تتصاعد الأوضاع أكثر إذا أصبح عباس أكثر ضعفا في خضم هذه الدورة أو حتى غادر المشهد. النتيجة الأكثر احتمالا في هذا السيناريو هي زيادة الفوضى في الضفة الغربية التي يمكن أن يتبعها عودة إسرائيلية إلى إعادة احتلال أجزاء أو كل الأراضي المحتلة، كما حدث في عام 2002.  لتجنب هذه النتيجة شبه المؤكدة، تحتاج السلطة الفلسطينية إلى استعادة شرعيتها. على الرغم من الاحتمال الضئيل للقيام بذلك في ظل القيادة الفلسطينية الحالية، فإن إجراء الانتخابات البرلمانية والرئاسية هو الخطوة العلاجية الأكثر أهمية وإلحاحا التي بدونها قد لا يكون ممكنا إيقاف الديناميات الحالية أو التخفيف من حدتها.  أما بالنسبة لإسرائيل، فإن الإجراء الأكثر أهمية هو إعادة حل الدولتين للحياة، وهي خطوة لا تستطيع الحكومة الإسرائيلية الحالية اتخاذها، مما يعني أن عملا فلسطينيا قويا أو الضغط الخارجي فقط هو الذي يمكن أن يبطئ الانهيار التدريجي الحالي لحل الدولتين.

 

أربع سمات رئيسية:

بدون إجراء انتخابات فلسطينية وإيقاف الجهود التي تبذلها إسرائيل لتعزيز احتلالها وجعله دائما، من المرجح أن تكون الخطوة التالية في عملية التصعيد هي إعادة احتلال كل أو أجزاء من المناطق الحضرية في الضفة الغربية. وبالنظر إلى تجربة إسرائيل مع إعادة احتلال الضفة الغربية في عام 2002، فإن قرار القيام بذلك في المستقبل القريب قد لا ينظر إليه على أنه محفوف بمخاطر أمنية ذات بال.

لكن الظروف التي قد تنتج عن هذا الاحتلال المتجدد قد تختلف عن تلك التي سادت آنذاك في خضم الانتفاضة الثانية. هناك أربع سمات رئيسية للواقع الحالي تفسر الفرق بين هذا السيناريو وسيناريو عام 2002، عندما أعاد الجيش الإسرائيلي احتلال المناطق الحضرية في الضفة الغربية ثم الخروج منها بدون تغيير جذري كبير في قواعد اللعبة. السمة الأولى تتمثل في أن السلطة الفلسطينية في ذلك الوقت كانت لا تزال تتمتع بشرعية ودعم كبيرين، وبالتالي كانت قادرة على الحفاظ على قدرتها واستعادة السيطرة بمجرد انسحاب الجيش الإسرائيلي. وعلى النقيض من ذلك، قد تحرم السلطة الفلسطينية الحالية، جزئيا أو كليا، من هذه القدرة، في بعض المناطق على الأقل، وتبعا للظروف السياسية الداخلية آنذاك، مما قد يجبر الجيش الإسرائيلي على البقاء لفترة أطول.

ثانيا، في حين كان الائتلاف الحاكم في إسرائيل في عام 2002 غير مهتم بضم الضفة الغربية بأكملها، أو حتى السيطرة الكاملة عليها، فإن الائتلاف الحالي منفتح على الأقل على فكرة إبقاء جيشه في مكانه أو حتى ضم أجزاء كبيرة من الضفة الغربية. وبذلك يتم إنشاء نظام فلسطيني إسرائيلي جديد، نظام يحل محل النظام المحتضر، الذي أنشأته عملية أوسلو.

ثالثا، في عام 2002، كان المجتمع الدولي، بقيادة الولايات المتحدة واللجنة الرباعية، المكونة من الولايات المتحدة وروسيا والاتحاد الأوروبي والأمم المتحدة، لا يزال منخرطا بعمق في الشرق الأوسط وكان على استعداد للتدخل وتقديم "خريطة طريق" لحل دائم للصراع الإسرائيلي الفلسطيني مبني على حل الدولتين. نصت تلك الخطة على بنود عملية سياسية للخروج من العنف المستعر. في ظل الظروف الحالية، وخاصة بالنظر إلى انسحاب الولايات المتحدة من الشرق الأوسط، من غير المرجح أن تلعب الولايات المتحدة والمجتمع الدولي أي دور ملموس. إن الجهود الحالية التي تقودها الولايات المتحدة والأردن ومصر لتسهيل خفض التصعيد الفلسطيني الإسرائيلي، كما هو الحال في الاجتماعات في العقبة وشرم الشيخ[4]، تبدو متأخرة جدا بحيث لا تؤثر على ديناميات التصعيد الحالية.

رابعا، بينما كان العالم العربي مستعدا في ذلك الوقت للالتقاء بطريقة غير مسبوقة وتقديم مبادرة السلام العربية لإسرائيل، وهي مبادرة سعودية عرضت إنهاء الصراع العربي الإسرائيلي بشكل دائم وأقرها مؤتمر القمة العربي في بيروت في عام 2002، أصبح العالم العربي الآن أقل اهتماما بالقضية الفلسطينية. وبدلا من ذلك، يركز على التهديد الإقليمي لإيران ويسعى لاحتوائه. لقد حطمت عملية التطبيع العربية مع إسرائيل، المعروفة بالاتفاقات الابراهيمية، مبادرة السلام العربية وتناقضت مع منطقها من خلال عرض السلام على إسرائيل دون إنهاء احتلالها بالضرورة أو السماح بإنشاء دولة فلسطينية إلى جانب إسرائيل. وفي حين أن هذه الاتفاقات قد لا تتوسع في ظل الظروف الحالية، فمن غير المرجح أن تكون إسرائيل أو شركاؤها العرب في التطبيع مهتمين بجعل السلام الفلسطيني الإسرائيلي محوريا في جهودهم. إن منتدى النقب الذي يجمع المطبعين مع إسرائيل يسعى لتسهيل التعاون الاقتصادي والأمني ويستبعد الفلسطينيين تماما. وحتى لو دعيت السلطة الفلسطينية للانضمام إلى المنتدى، فإنها ستجد أنه من المستحيل القيام بذلك في غياب التزام باستئناف المفاوضات الفلسطينية-الإسرائيلية على أساس مبادرة السلام العربية، وهو شرط سترفضه على الأرجح إسرائيل ودول التطبيع العربية. النتيجة النهائية هي أن السلطة الفلسطينية ستظل عاجزة عن إيجاد الوسائل لاستعادة الدعم السياسي أو المالي العربي.

ومع بدء تصادم هذين التطورين، الفلسطيني والإسرائيلي، الموصوفين أعلاه، فإن جهود الولايات المتحدة، وجهود بقية المجتمع الدولي واللاعبين العرب الإقليميين الرئيسيين، التي تقتصر حاليا على تشجيع خفض التصعيد قد لا يكتب لها النجاح. هذه الجهود قد لا تنجح لأنها عير معنية بمعالجة الديناميات التي ولدت التطورات الجديدة تدريجيا. صحيح أن جميع اللاعبين الدوليين يؤيدون على ما يبدو حل الدولتين الذي يؤدي إلى إنشاء دولة فلسطينية قابلة للحياة إلى جانب إسرائيل. ولكن لا أحد على استعداد لاتخاذ تدابير فعالة لجعله حقيقة واقعة. وبالتالي، فإن الدعم لهذا الحل يفتقر للمصداقية.

لفهم السبب وراء توقعات الفشل هذه، يحتاج المرء إلى فهم طبيعة الديناميات التي أنتجت التطورين: ما الذي أوصلنا إلى هذه النقطة، والآثار طويلة الأجل.

 

ولادة إسرائيل الجديدة:

ما يميز إسرائيل الجديدة بالإضافة إلى هيمنة القوى الدينية القومية هو رفض حل الدولتين وأي انخراط مع الفلسطينيين في مفاوضات سلام على أساس هذا الحل. كما أنها تتميز بضم زاحف بحكم الأمر الواقع، وهو ضم يكتسب زخما مدفوعا بسياسات الحكومة الجديدة، والذي قد يتم تسهيله قريبا لو نجحت هذه الحكومة في إضعاف القضاء الإسرائيلي. يمكن للأجندة الدينية لإسرائيل الجديدة أن تقوض وتدمر في نهاية المطاف الوضع في الأماكن المقدسة في القدس. تظهر إسرائيل الجديدة تصميما أكبر على فرض إجراءات عقابية ضد السلطة الفلسطينية بسبب الحملة الدولية التي تشنها الأخيرة ضد إسرائيل. في شباط/فبراير 2023، ضاعفت وزير المالية الاسرائيلي الجديد، رئيس حزب الصهيونية الدينية بتساليل سموتريتش، مبلغ عائدات الجمارك الشهرية الفلسطينية التي تحتجزها عادة، والتي تبلغ الآن 40 مليون دولار أمريكي ليدفعها لضحايا العمليات الفلسطينية، وذلك في خطوة عقابية لجهود السلطة ضد إسرائيل في المحافل الدولية.  أعلن وزير المالية آنذاك أنه غير معني باستمرار وجود السلطة الفلسطينية[5]. والنتيجة الحتمية هي أن الضعف الحالي للسلطة الفلسطينية سوف يتسارع.

ساهمت ثلاثة عوامل خارجية في التطور الحالي على مدى ما يقرب من 15 عاما، مما أعطى الجناح اليميني والتطرف القومي الديني في إسرائيل مجالا للنمو والحكم. الأول هو فشل الولايات المتحدة في استخدام نفوذها على حكومة ائتلاف يمين الوسط التي تم إنشاؤها بقيادة نتنياهو في عام 2009، عندما كانت القيادة الفلسطينية لا تزال تتمتع بالشرعية الشعبية، وبالتالي كانت لا تزال قادرة على صنع السلام. ضغطت إدارة أوباما على إسرائيل لتجميد البناء الاستيطاني، لكنها لم تفعل شيئا للضغط على نتنياهو لمواصلة ما يسمى بعملية أنابوليس التي بدأتها إدارة بوش قبل أكثر من عام. في المنافسة بين أوباما ورئيس الوزراء الإسرائيلي، كان نتنياهو هو الذي تمكن من إثبات أن إسرائيل لديها على الأقل تكافؤ في العلاقات الثنائية مع الولايات المتحدة وأن إسرائيل، في الواقع، لديها نفوذ كبير على الإدارة الأمريكية.

ثم سرعان ما تبلور في إسرائيل تصور بأنها دولة لا تقهر.  أعطت السنوات الأربع التي قضاها دونالد ترامب في منصبه النظام السياسي اليميني والجمهور الإسرائيلي انطباعا بأن دولتهم يمكنها أن تفعل ما تشاء دون اعتبار للقانون الدولي أو المصالح الأكثر حيوية للفلسطينيين. بحلول منتصف عام 2020، تجاوز التأييد بين اليهود الإسرائيليين لضم أجزاء من الضفة الغربية، مثل غور الأردن، النصف، حيث بلغ أكثر من 70٪ بين الناخبين اليمينيين[6]. انخفض تأييد حل الدولتين بين اليهود الإسرائيليين من 51٪ في منتصف عام 2016، قبل تولي ترامب منصبه، إلى 42٪ في آب (أغسطس) 2020، قبيل نهاية ولاية ترامب، انخفاض بلغ 9 نقاط مئوية.[7]

ثم جاءت لحظة الإغراء الأعظم. قبل أن يترك ترامب منصبه، كافأ اللاعبون الإقليميون العرب إسرائيل. مدفوعين بتقديراتهم للتهديدات الإقليمية الإيرانية ومدفوعين بالنجاحات الإسرائيلية والعجز الفلسطيني، قامت هذه الدول بتطبيع العلاقات الأمنية والاقتصادية مع إسرائيل. لماذا إذا ستقدم إسرائيل تنازلات للفلسطينيين إذا كان من الممكن جني ثمار السلام العربي الإسرائيلي دون الحاجة إلى دفع الثمن. ساهم التطبيع العربي في إضعاف إسرائيل العلمانية وتمكين إسرائيل القومية الدينية. بعد عامين من التطبيع العربي، بحلول كانون الأول/ديسمبر 2022، انخفض الدعم اليهودي الإسرائيلي لحل الدولتين إلى الثلث فقط، في انخفاض آخر بمقدار 8 نقاط مئوية في غضون عامين فقط، وبلغت نسبة تأييد هذا الحل 14٪ فقط بين الناخبين اليمينيين. حصلت نسبة تأييد قيام دولة واحدة في كامل مساحة فلسطين التاريخية يتمتع فيها اليهود بحقوق كاملة ويتمتع فيها الفلسطينيون بحقوق جزئية على تأييد أكبر بين اليهود الإسرائيليين من تأييد حل الدولتين (37٪ و34٪ على التوالي)[8].

على الصعيد المحلي، بالإضافة إلى التحول التدريجي إلى اليمين في الحياة السياسية الإسرائيلية، وهي عملية بدأت في عام 1977، ربما كانت المساهمة الأولى والأكثر أهمية في صنع إسرائيل القومية الدينية هي الاتجاه الذي بدأ في عام 2009 وتعزز في عام 2015، حيث تحالفت الجماعات الدينية والدينية القومية المتطرفة في ائتلافات حكومية مع نتنياهو والليكود فقط. وللاستفادة الكاملة من تحقيق ائتلافه للمكاسب، احتاج نتنياهو العلماني إلى استرضاء الهوامش الأكثر تطرفا وإضفاء الشرعية عليها، وبالتالي جعلها مسوغة أو مقبولة من الرأي العام . في عام 2022، بذل نتنياهو جهودا كبيرة لمساعدة الأحزاب المتطرفة الصغيرة على توحيد قواها، وأهمها تلك الممثلة في القائمة الانتخابية للصهيونية الدينية وحلفائها من حزبي عوتسما يهوديت ونوعم، حتى يتمكنوا جميعا من اجتياز العتبة الانتخابية. ثم جاءت مشاكل نتنياهو القانونية الشخصية حيث أجبرته محاكمته بالفساد في أواخر عام 2022 على تشكيل ائتلاف مع أولئك الذين يمكنهم السماح له بإعادة هيكلة القضاء الإسرائيلي وإضعاف استقلاليته.

في ظل هذه التطورات، من نافلة القول إنه لا يمكن توقع أن تتخذ إسرائيل القومية الدينية الحالية سوى تدابير إضافية من شأنها أن تسرع بزوال حل الدولتين بدلا من إنقاذه.   ولإنقاذ هذا الحل، سيتعين على القيادة الفلسطينية أن تستعد لتبني استراتيجية للمواجهة يمكنها أن تؤدي لانهيار السلطة الفلسطينية، وهي خطوة من المرجح أن تصر القيادة الحالية على تجنبها. في غياب ذلك، يمكن لقيادة السلطة الفلسطينية أن تسعى للحصول على دعم عربي ودولي للخطوات التي قد تجعل من الصعب على إسرائيل القومية الدينية أن تدمر تماما ما تبقى من حل الدولتين. بدعم من الولايات المتحدة والاتحاد الأوروبي، يمكنها تنسيق سياستها هذه مع الدول العربية المعنية بتطبيع علاقاتها مع إسرائيل، مثل المملكة العربية السعودية وغيرها. يمكن أن يكون التطبيع العربي القادم مشروطا بمقايضة ملموسة، مثل انسحاب إسرائيل من معظم المنطقة (ج)، وزيادة ولاية السلطة الفلسطينية في المناطق الخاضعة لسيطرتها، وفتح الأراضي المتبقية من المنطقة (ج) للأنشطة الاقتصادية الفلسطينية، وبناء ممر تسيطر عليه السلطة الفلسطينية يربط بين الضفة الغربية وقطاع غزة. بالتأكيد لن يكون أي من هذه الإجراءات مقبولا لدى الحكومة الإسرائيلية الحالية دون موقف عربي ودولي قوي وموحد، وهو أمر مستبعد للغاية في ظل الظروف الحالية وغياب التركيز على القضية الفلسطينية-الإسرائيلية.

 

الإخفاقات الفلسطينية:

إن ما يميز التطورات الفلسطينية الأخيرة بالإضافة إلى العجز المتزايد عن الحفاظ على احتكار القوة المسلحة هو عدم القدرة على تنظيم الانتخابات أو إعادة توحيد الضفة الغربية وقطاع غزة. وفي غياب عملية سلام، أصبحت العلاقات الفلسطينية الإسرائيلية عدائية. كان المكان الرئيسي لمواجهة السلطة الفلسطينية مع إسرائيل هو المؤسسات الدولية. لكن هذه المواجهة مكلفة، ويرجع ذلك في الغالب إلى حقيقة أنها غير متماثلة. فالسلطة الفلسطينية لا تملك نفوذا كبيرا على إسرائيل، في حين يمكن لإسرائيل أن تفرض عليها تكاليف عقابية مالية وغير مالية من خلال حرمان الفلسطينيين من الموارد والفرص الاقتصادية.

ما الذي جعل السلطة الفلسطينية ضعيفة لدرجة أنها لا تستطيع ضمان احتكار القوة؟ الجواب يكمن في فقدانها للشرعية الانتخابية وغير الانتخابية. انتهت ولاية الرئيس في عام 2010، فحكم بعد ذلك لمدة 13 عاما دون تفويض شعبي. طوال هذه السنوات منع رئيس السلطة الفلسطينية إجراء انتخابات برلمانية ورئاسية. ونتيجة لذلك، انخفضت ثقة الجمهور بحكومة السلطة الفلسطينية من 68٪ عند انتخابها لأول مرة في عام 2006 إلى 27٪ بحلول نهاية عام 2021. نسبة الاعتقاد بوجود فساد في مؤسسات السلطة الفلسطينية بلغت 86٪ خلال معظم العقد الماضي. وخلال الفترة نفسها، طالبت الغالبية العظمى من الفلسطينيين باستقالة الرئيس عباس. تبلغ نسبة المطالبة باستقالته اليوم 80٪[9]. وينظر الفلسطينيون الآن إلى السلطة الفلسطينية باعتبارها عبئا على الشعب الفلسطيني. الأغلبية ترى في استمرارها خدمة لمصلحة إسرائيل وترى في تفككها أو انهيارها خدمة لمصلحة الشعب الفلسطيني[10].

جاء فشل السلطة الفلسطينية في الأساس بسبب سياساتها الداخلية. في العقد الماضي، اتخذت السلطة الفلسطينية في الضفة الغربية عدة تدابير قوضت بشدة الحكم الرشيد وألغت أي مساءلة ذات مغزى في النظام السياسي. وقد تضررت أربع مجالات بشدة: الفصل بين السلطات، واستقلال القضاء، واستقلال وتعددية المجتمع المدني ومنظماته، ووسائل الإعلام وحرية التعبير. بدون انتخابات عامة منذ عام 2006، كان الضرر الذي لحق بهذه المجالات الأربعة مدمرا: فقد تم حل البرلمان، والتضحية بسيادة القانون، وإضعاف القضاء وتضرر استقلاله، وتقليص الحريات الإعلامية إلى حد كبير، وتقليص مساحة عمل المجتمع المدني حيث فقدت منظماته الكثير من استقلالها عن الحكومة.

وتجدر الإشارة إلى أن العوامل الخارجية، كما هو الحال بالنسبة لإسرائيل، حاسمة أيضا. وباهتمام ضئيل أو معدوم من المجتمع الدولي، أصبحت السلطة الفلسطينية على مدى العقد الماضي، ولا سيما منذ الربيع العربي، أكثر جرأة في تجاهل قانونها الأساسي وسيادة القانون بينما تسعى إلى تعزيز سلطة الرئاسة والسلطة التنفيذية ككل وإضعاف جميع أطراف المعارضة، بما في ذلك معارضة المجتمع المدني. وخوفا من صعود الاسلاميين والإرهاب والحروب الأهلية، بدا المجتمع الدولي أقل اهتماما بالحكم الرشيد الفلسطيني. في مرحلة ما بعد الربيع العربي، أخذ التركيز على الاستقرار يحل محل الأجندة التقليدية للديمقراطية والحكم الرشيد.

ومع ذلك، فإن الاستبداد الفلسطيني نابع من الداخل. في وقت مبكر من عام 2007، عندما سيطرت حماس بعنف على قطاع غزة، زرعت البذور المبكرة للاستبداد في السياسة الفلسطينية. وقد أدى ذلك بالسلطة الفلسطينية بقيادة الرئيس عباس إلى اتخاذ تدابير فورية تجاهلت المتطلبات الدستورية وسيادة القانون. وجاء التنافس الداخلي داخل فتح بعد ذلك، مما أدى إلى صراع على السلطة كان من السهل فيه إلحاق المزيد من الضرر بسيادة القانون وحرية التعبير والتعددية في المجتمع المدني. لا يمكن تفسير السهولة المذهلة في حصول ذلك إلا بالطبيعة غير الديمقراطية للنخبة الفلسطينية الحاكمة. عدد قليل فقط من أعضاء النخبة الوطنية الراهنة هم ديمقراطيون حقا ويبدو أن النخبة الإسلامية أسوء من ذلك. وبدون الكوابح التي توجد عادة بين الديمقراطيين، وجدت البيروقراطية الفلسطينية العليا في السلطة التنفيذية نفسها خالية من أي رقابة أو مساءلة ذات مغزى. ومن دون قيود على قدرتها على الحكم كما تراه مناسبا، وجد أعضاء قيادة السلطة الفلسطينية، وأهمهم الرئيس ووزرائه، أنه من الأسهل أن يحكموا دون أن يزعجهم البرلمان أو المحاكم أو المجتمع المدني أو وسائل الإعلام.

من شبه المؤكد أن السلطة الفلسطينية لن تحسم أمرها تجاه القيام بخطوة قوية لمواجهة إسرائيل الجديدة، كبلورة إجماع وطني على حل الدولة الواحدة، أو قيادة حملة مقاومة شعبية سلمية واسعة النطاق، أو تبني استراتيجية دفاع مسلح في مناطق سيطرتها.  وإذا كان إجراء الانتخابات غير وارد في ظل الظروف الحالية، فينبغي اتخاذ خطوات لإبطاء أو إلغاء التدابير الاستبدادية التي اتخذتها السلطة الفلسطينية خلال العقد الماضي. بدعم عربي ودولي، يمكن بذل الجهود لتشكيل حكومة وحدة وطنية مع حماس وجماعات المعارضة الأخرى التي يمكنها أن تعيد توحيد الضفة الغربية وقطاع غزة. وباستثناء إجراء الانتخابات، قد يعهد إلى الحكومة الجديدة بأربع مهام. يمكنها أولا اعتماد أجندة تشريعية تسعى إلى تعديل المراسيم الرئاسية القائمة لجعلها متسقة مع القانون الأساسي الفلسطيني. ويمكن أن تكون استعادة دور القضاء المستقل هو الخطوة الحيوية الثانية لحكومة الوحدة الوطنية. ثالثا، يمكن لهذه الحكومة أن تزيل القيود المنهكة الحالية المفروضة على المجتمع المدني والصحافة مما قد يسمح لهما بالازدهار واستعادة القوة والحيوية التي فقداها خلال العقد الماضي. أخيرا، يمكن لحكومة الوحدة الوطنية أن تعيد الاحترام للحريات وحقوق الانسان وتضع حدا لتجاوزات الأجهزة الأمنية وتخضعها للمساءلة. وفي حين أن هذه التدابير قد لا تكون كافية لاستعادة الشرعية الكاملة للسلطة الفلسطينية وقيادتها، إلا أنها يمكن أن تساعد على استعادة بعض الثقة المفقودة في المؤسسات العامة والسماح للسلطة الفلسطينية باستعادة زمام المبادرة وبالتالي منحها الشجاعة لاتخاذ قرارات صعبة.

 

إلى أين؟

قد تؤدي الديناميات المذكورة أعلاه بالفعل لبدء حقبة جديدة في العلاقات الفلسطينية الإسرائيلية. مع اقتراب آفاق السلام القائم على حل الدولتين من نهايتها، يدخل الصراع الفلسطيني الإسرائيلي الآن مرحلة جديدة، مرحلة قد لا يكون فيها تقسيم الأرض خيارا متاحا، وبذلك تأتي نهاية الدبلوماسية والمفاوضات، ويتحول اهتمام الجهات الفاعلة الآن إلى وسائل أخرى لحل الصراع. بالنسبة للإسرائيليين، يعني ذلك تعزيز بناء المستوطنات والخطوات لتغيير الوضع الراهن فيما يتعلق بالسيطرة والسيادة على الأرض والأماكن المقدسة من خلال إجراءات قانونية داخلية. أما بالنسبة للفلسطينيين فإن ذلك قد يعني العودة لاستخدام القوة.

This moment might prove to be a turning point in the Palestinian-Israeli conflict, perhaps as important as the one that unfolded 30 years ago and became known as the Oslo process. While it is difficult to assess the future outcome of the current dynamics, it does not look good for Palestine or Israel.

The near future will be shaped by the collision of two developments, one Palestinian and one Israeli. On the Palestinian side, the Palestinian Authority (PA) has now reached the point where it can no longer fully meet Israel’s security expectations in ensuring a “monopoly” over coercive force in areas under its control. This development is currently evident in the formation of armed groups led by young Palestinians in cities and refugee camps, most prominently in the northern part of the West Bank. On top of that, Palestinians strongly believe that it was the costs imposed on Israel during the first and second intifadas that convinced it to view a Palestinian state as an Israeli national interest. It is this belief in the utility of force that is now fueling the rise of armed groups in the West Bank.

On the Israeli side, a “New Israel” is emerging, one characterized by a national-religious ideology eager to push away the Secular Israel that Palestinians have known during most of the past 30 years of the Oslo agreement and assert Israel’s permanent control over the West Bank. The formation of the current Israeli right wing and extreme government, dominated for the first time in Israel’s history by mostly religious and national-religious political parties, is the clearest sign to date of the second development. In the “New Israel,” the national-religious coalition seems to take the Palestinian-Israeli conflict back to its existential roots.

This paper explores the conditions that have led to the current developments in Israel and Palestine, conditions that might lead to the anticipated collision, and how Palestinians and Israelis might be able to avert it. In the scenario of collision, the PA continues to lose legitimacy and the trust of its own people. It is weakened further by Israeli punitive measures and increased military incursions into the Palestinian territories. The combined effect could lead to reduced PA law enforcement capacity thereby generating increased security vacuum in parts of the West Bank and the resultant formation of new Palestinian armed groups willing to challenge both the PA security forces and those of Israel. As the Israeli army seeks to fill the vacuum, it further weakens the PA leading to a vicious cycle of violence and bloodshed. Last year was the most violent in Palestinian-Israeli relations since the end of the second intifada. The number of armed clashes[1] with the Israeli army has increased at least three times compared to 2021. Palestinian deaths in the West Bank alone stood at 146, the highest since 2005[2]. Israeli deaths stood at 31, the highest since 2008[3]. Settlers’ violent incidents against Palestinians stood in 2022 at 755 compared to 496 in 2021 and 358 in 2020.

Conditions could further escalate if in the midst of this cycle, Abbas becomes marginal or even departs the scene. The most probable outcome in this scenario, is increased anarchy in the West Bank that could be followed by an Israeli return to the reoccupation of parts or all of the occupied territories, as it did in 2002 in the midst of the second intifada. To avoid this outcome the PA needs to restore its legitimacy. Despite the low probability of this outcome under the current Palestinian leadership, the holding of parliamentary and presidential elections is the most critical and urgent remedial step without which the current dynamics cannot be stopped or mitigated.  For Israel, the most critical measure is to restore the viability of the two-state solution, a step the current Israeli government cannot take, which means only dramatic Palestinian action or external pressure can slow down the gradual demise of the two-state solution.  

 

Four features

Without Palestinian elections and the reversal of Israel’s efforts to consolidate its occupation and make it permanent, the next step in the escalatory process will most likely be the reoccupation of all or parts of West Bank urban areas. Given Israel’s experience with the 2002 reoccupation of the West Bank, the decision to do so in the near future might not be seen as too risky.

But the conditions that might be triggered by this anticipated Israeli reoccupation might be different than those prevailing back then in the aftermath of the Israeli occupation of Palestinian urban areas. Four main features of the current reality explain the difference between this scenario and that of 2002. The first is that the PA back then was still enjoying considerable legitimacy and support and was therefore able to maintain its capacity and restore control once the Israeli army pulled out. By contrast, the current PA, depending on the prevailing Palestinian domestic conditions during the reoccupation, might be deprived, partly or completely, of that capacity thus compelling the Israeli army to stay longer.

Secondly, while the Israeli governing coalition in 2002 was not at all interested in annexing, or even fully controlling, the entire West Bank, the current one is at least open to the idea of keeping its army in place or even annexing large parts of the West Bank. A new Palestinian-Israeli order would thereby be created, one that would replace the currently dying order created by the Oslo process.

Thirdly, in 2002 the international community, led by the US and the Quartet, made up of the US, Russia, the EU, and the UN, were still deeply involved in the Middle East and were willing to step in and provide a “Performance-based Road Map to a Permanent Two-State Solution to the Israeli-Palestinian Conflict.” That plan provided for a political process out of the raging violence. Under current conditions, particularly given the US withdrawal from the Middle East, the US and the international community are not likely to play any tangible role. The current efforts led by the US, Jordan, and Egypt to facilitate a Palestinian-Israeli de-escalation, as in the meetings in Aqaba and Sharm al Sheikh[4], seem too little too late to make a dent on the current escalatory dynamics.

Fourthly, while the Arab World was willing at that time to come together in an unprecedented manner and offer Israel its Arab Peace Initiative (API), a Saudi initiative that offered to permanently end the Arab-Israeli conflict that was endorsed by the Beirut Arab Summit in 2002, the Arab world is now much less interested in the Palestinian issue. Instead, it is focused on the regional threat of Iran. The Abraham Accords have shattered the API and contradicted its logic by offering Israel peace with Arab countries without necessarily ending its occupation or allowing the creation of a Palestinian state alongside Israel. While these accords might not expand under current conditions, it is highly unlikely that Israel or its Arab normalization partners would be interested in making the Palestinian-Israeli peace central to their efforts. The Negev Forum that joins these normalizers with Israel in facilitating economic and security cooperation already excludes the Palestinians. Even if the PA is invited to join the forum, it will find it impossible to do so in the absence of a commitment to restore Palestinian-Israeli negotiations on the basis of API, a condition that will most likely be rejected by Israel and the Arab normalizers. The end result is that the PA will continue to be unable to find the means to regain Arab political or financial support

As these two developments described above begin to collide, US efforts, and those of the rest of the international community and the main regional Arab players, are currently restricted to encouraging de-escalation. These efforts are not interested in addressing the dynamics that have gradually generated the new developments. They will therefore fail. It is true that all international players seem to endorse the two-state solution that leads to the creation of a viable Palestinian state alongside Israel. But no one is willing to take effective measures to make it a reality; the support, therefore, is empty rhetoric. 

To understand the reason behind the expectations of failure, one needs to understand the nature of the dynamics that produced the two developments: what brought us to this point, and the long-term implications.

 

The birth of the “New Israel”

What characterizes the New Israel in addition to the dominance of religious-nationalist forces is the rejection of the two-state solution and any engagement with the Palestinians in peace negotiations based on that solution. It is also characterized by a de facto creeping annexation, one that is gaining momentum driven by policies of the new government and that will soon be further facilitated by the weakening of the Israeli judiciary. The religious agenda of New Israel could undermine and eventually destroy the status que in holy places in Jerusalem. The New Israel is showing greater determination to impose punitive measures against the PA due to the latter’s international campaign against Israel. In February 2023, the new Israeli finance minister doubled the amount of the Palestinian monthly custom revenues Israel normally withholds, by directing an additional $40 million to the families of Israeli victims of Palestinian attacks in a punitive measure against the PA’s international campaign against Israel.[5]  In doing so, the minister, Bezalel Smotrich, leader of the Religious Zionist Party, made it clear that he has no interest in the continued existence of the PA. The inevitable outcome is that the current weakening of the PA will accelerate.

Three external factors contributed to the current development over a period of almost 15 years, giving Israel’s right wing and national-religious extremism room to grow and rule. The first was the failure of the US to use leverage on the newly created right-center coalition government led by Netanyahu in 2009, when the Palestinian leadership was still enjoying popular legitimacy and hence was still capable of making peace. The Obama Administration did pressure Israel to freeze settlement construction, but it did nothing to press Netanyahu to continue the so-called Annapolis process that was initiated more than a year earlier by the Bush Administration. In the contest between Obama and the Israeli prime minister, it was Netanyahu who managed to demonstrate that Israel had at least parity in the bilateral relations and that Israel, in fact, had significant leverage over the US administration.

Then came the perception of invincibility.  Donald Trump’s four years in office gave Israel’s right-wing polity and public the perception that their state can do whatever it wants without regard to international law or the most vital interests of the Palestinians. By mid-2020, support among Israeli Jews for the annexation of parts of the West Bank, such as the Jordan Valley, exceeded half, standing at more than 70%[6] among right wing voters. Support for the two-state solution among Israeli Jews dropped from 51% in mid-2016, before Trump took office, to 42% by August 2020, just before the end of the Trump term in office; a 9-point drop[7].

Then came the greatest temptation. Before Trump left office, Arab regional players, pushed by perceived regional threats and pulled by Israeli successes and Palestinian impotence, rewarded Israel with normalization of security and economic relations. Why make concessions to the Palestinians if the fruits of Arab-Israeli peace can be gained without having to pay a price. Arab normalization contributed to the ongoing weakening of secular Israel and the empowerment of the national-religious one. After two years of Arab normalization, by December 2022, Israeli Jewish support for the two-state solution dropped further to just one third; another 8-point drop in just two years, and just 14% among right wing voters. Support for a single state in entire area of historic Palestine where Jews enjoy full rights and Palestinians enjoy partial rights received more support than the support for the two-state solution, 37% and 34%[8] respectively.

Domestically, in addition to the gradual shift to the right in Israeli political life, a process that started in 1977, perhaps the first and most critical contribution to the making of national-religious Israel was the trend that started in 2009 and consolidated in 2015, by which religious and extreme national-religious groups, allied themselves in government coalitions solely to Netanyahu and his right-wing Likud party. To take full advantage of his coalition making gains, the secular Netanyahu needed to appease and legitimize the most extreme fringe thus making them mainstream. In 2022, he made efforts to help small extremist parties to join forces, most importantly those represented in the electoral list of Religious Zionism and its allies from Otzma Yehudit and Noam party, so that all of them would be able to pass the electoral threshold. Then came Netanyahu’s personal legal problems. His corruption trial forced him in late 2022 to form a coalition with only those who could allow him to restructure the Israeli judiciary and weaken its independence.

Given these developments, it goes without saying that the current national-religious Israel can be expected to only take additional measures that would accelerate the demise of the two-state solution rather than saving it.   To save it, the Palestinian leadership would have to prepared to take confrontational measures that could risk the collapse of the PA, a step the current leadership will most likely insist on avoiding. Alternatively, the PA leadership could seek Arab and international support for steps that might make it more difficult for national-religious Israel to completely destroy what remains of the two-state solution. With US and EU support, it could coordinate its own policy with the Arab countries interested in normalizing relations with Israel, such as Saudi Arabia and others. Additional normalization could be conditioned on concrete Israeli quid pro quo, such as an Israeli withdrawal from most of area C, greater PA jurisdiction  in areas of its current control, opening area C for Palestinian economic activities, and the construction of a PA-controlled corridor linking the West Bank and the Gaza Strip. None of these measures will be acceptable to the current Israeli government without a strong and unified Arab and international stand, highly unlikely under current conditions and the lack of focus on the Palestinian-Israeli issue.

 

Palestinian failures

What characterizes Palestinian recent developments in addition to the growing inability to maintain monopoly over coercive force is an inability to organize elections or reunify the West Bank and the Gaza Strip. In the absence of a peace process, Palestinian-Israeli relations became hostile. The main venue for PA confrontation with Israel has been international institutions. This confrontation is costly, mostly due to the fact that it is asymmetric; the PA has little leverage over Israel while Israel can punitively impose financial costs on it by denying the Palestinians resources and economic opportunities.

What made the PA so weak that it cannot ensure monopoly over force? The answer lies in its loss of legitimacy, electoral and non-electoral. The term of the president ended in 2010. He ruled for 13 years without a popular mandate. For all these years the PA president has prevented the holding of parliamentary and presidential elections. As a result, public trust in the PA government declined from 68% when it was first elected in 2006 to 27% by the end of 2021. Perception that corruption exists in the PA institutions went as high as 86% for most of the past decade. During the same period, the vast majority of Palestinians demanded the resignation of president Abbas[9]; demand for his resignation stands today at 80%. Palestinians now view the PA as a burden on the Palestinian people; a majority views its continued existence as serving the interests of Israel and views its dissolution or collapse[10] as serving the interest of the Palestinian people.

This PA failure came mostly from its own internal dynamics. In the past decade, the PA in the West Bank has taken several measures that have severely undermined good governance and eliminated any meaningful accountability in the political system. Four areas have been severely damaged: the separation of power, the independence of the judiciary, the independence and pluralism of civil society and its organizations, and the media and freedom of expression. Without general elections since 2006, the damage inflicted in these four areas was destructive: the parliament was dissolved, rule of law has been sacrificed, the judiciary has been weakened and its independence damaged, media freedoms have been highly curtailed, and the space for civil society has significantly shrunk as its organizations lost much of its independence from the government.

It should be pointed out that, as the case with Israel, external factors were also critical. With little or no attention from the international community, the PA had over the last decade, particularly since the Arab Spring, become bolder in ignoring its own Basic Law and rule of law while seeking to strengthen the power of the presidency and the executive as a whole and to weaken all opposition, including that of civil society. Fearing Islamism, terrorism, and civil wars, the international community seemed much less interested in Palestinian good governance. A post Arab Spring a focus on stability was replacing the traditional agenda of democracy and good governance.

Nonetheless, Palestinian authoritarianism is home grown. As early as 2007, when Hamas violently took over control over the Gaza Strip, the early seeds of authoritarianism in Palestinian politics were planted. It led the PA under Abbas to take immediate measures that sacrificed constitutional requirements and rule of law. Internal rivalry inside Fatah came next, leading to a power struggle in which further damage to rule of law, freedom of speech, and pluralism in civil society was easily done. The reason it was easy can only be explained by the non-democratic nature of the ruling Palestinian elite. Only few of the members of the secular nationalist elite and almost none of the Islamist elite are truly democratic. Without the brakes normally found among democrats, the senior Palestinian bureaucracy in the executive branch found itself free of any meaningful oversight or accountability. Without restrictions on its ability to rule as it saw fit, members of the PA leadership, most importantly the president and his ministers, found it easier to rule without being bothered by a parliament, courts, civil society, or the media.

The PA will almost certainly not embrace a strong or decisive stance in confronting the new national-religious Israel, such as forging a national consensus on a one-state solution, leading a large-scale peaceful popular resistance campaign, or adopting an armed defense strategy in areas under its control. Similarly, holding elections under current conditions might also be out of the question. If so, perhaps steps should be taken to slow down or reverse the authoritarian measures the PA has taken during the past decade. With Arab and international support, efforts could be made to form a national unity government with Hamas and other opposition groups that could reunify the West Bank and the Gaza Strip. Short of holding elections, four tasks might be entrusted in the new government. It could adopt a legislative agenda that seeks to amend existing presidential decrees to make them consistent with the Palestinian Basic Law. The restoration of a truly independent judiciary could be a second vital measure for the national unity government. That government could also remove current debilitating restrictions on civil society and the media allowing them to prosper and regain the strength and vitality they had lost during the past decade. Finally, the national unity government could restore liberties and respect for human rights and put an end to the excesses of the security services and bring those services to accountability. While these measures might not be sufficient to restore full legitimacy to the PA and its leadership, it could help to restore some of the lost trust in public institutions and allow the PA to regain the initiative thereby giving it the courage to make difficult decisions.

 

Where to?

The dynamics described above might usher in a new era in Palestinian-Israeli relations. With the prospects for peace based on a two-state solution coming to an end, the Palestinian-Israeli conflict enters a new phase, one in which partition of the land might no longer an option. With that comes the end of diplomacy and negotiations. Attention of the actors now shifts to other means of resolving the conflict. For the Israelis, this means consolidated settlements construction and domestic legal steps to change the status quo regarding control and sovereignty over the land and the holy places. For the Palestinians, it could mean a return to the use of force.

The PA and the international community will find it difficult to acknowledge this reality. Nonetheless, they are not stupid; they just have no viable alternative. The PA is interested in survival and continued donor support.  For that, it is highly dependent on Israel and therefore cannot directly challenge it. Instead of taking effective concrete measures of its own to shape conditions on the ground and counter the punitive measures of the new Israel, it is content with calling upon the international community do so. Thus, it is faced with navigating its conflicting interests at a time when it is at a historically low point in terms of legitimacy and credibility in the eyes of its own public. As it becomes weaker the prospects for a violent conflict with Israel increases.

The US and the rest of the international community cannot but realize that the process that is now ongoing can only end in the demise of the two-state solution. Nonetheless, they are unwilling to take the only effective measures to force Israel and the PA to turn away from the path of folly: elections for the Palestinians and a commitment, in words and deeds, to the two-state solution for Israel.

The results of the recent Israeli elections last November led to a fundamental change in the Israeli political and partisan map, with the right and the extreme right winning a majority in the Knesset of 64 seats out of 120. This victory allowed Benjamin Netanyahu's Likud party to form the government in coalition with the "Religious Zionism" list, which includes the three most radical and racist Israeli parties, and with the religious fundamentalist movements "Shas" and "United Torah Judaism." This government is the most right-wing and extreme government in Israel's history. For the first time, the "Religious Zionism" movement won a large number of seats and became, with its fourteen members of the Knesset, the third list in the parliament. This victory gave its leaders Bezalel Smotrich, leader of the "Religious Zionism" party, Itamar Ben-Gvir, head of the "Jewish Power" party, and Avi Maoz, leader of the "Noam" party, the power to dictate their conditions to Netanyahu so that he could establish a stable government. The price that Netanyahu has paid will be at the expense of the Palestinians primarily and at the expense of the image and nature of Israel, its political system, and certain sectors of the Israeli society.

The current composition of the government undoubtedly demonstrates that it will work against any Palestinian aspiration for an independent state in the immediate and long-term. The Likud party and its leader, Netanyahu, embrace the principle of "conflict management" and "economic peace" contained in the Trump’s “Deal of the Century," which was originally drafted in full harmony with the position of Netanyahu and the Israeli right. Netanyahu completely rejects the withdrawal to the 1967 borders, and refuses to divide Jerusalem or "give up" any part of it on the grounds that "full and united Jerusalem is the capital of Israel," as stated in the Nation-State Law enacted by the Knesset in 2018. He wants to impose Israeli sovereignty over the Jordan Valley and the settlements in the West Bank, while retaining in Israel's hands full and absolute security control over all of historic Palestine. The Likud and the current government reject the return of any Palestinian refugees within Israel's borders, and consider Arab countries responsible for them. In conclusion, the Likud and the government consider that the conflict is not over part of historic Palestine, but over all of it, and that it is an existential conflict, not just over borders.

The tripartite "religious-Zionist" list is more hardline than the Likud, rejecting any political process that allows the establishment of a Palestinian state that its electoral platform calls a "state of terror." It wishes to "impose Israeli sovereignty over all areas of the Land of Israel," or historic Palestine.

In reality, we are dealing with an extreme right-wing government that engraves on its banner the killing of the idea of a political settlement based on the two-state solution on the borders of the fourth of June 1967. Instead, it will seek with all its strength to permanently block this idea. All the coalition parties, especially the trio of Netanyahu, Smotrich and Ben Gvir, do not even support maintaining the bad status quo as it is, but will escalate things further. They certainly pose a grave and immediate threat to Palestinian national rights and aspirations.

This paper aims to shed light on the changes taking place in the Israeli policy towards the Palestinian-Israeli conflict after the formation of the new government, the extent of its threat and impact on the reality in the Palestinian territories and on the overall national cause. But it mainly addresses what Palestinians can and should do to avoid the risks resulting from the developing threat and preserve national rights. It takes into consideration the magnitude of the domestic Israeli, regional and international opposition to the fledgling government's policy. 

Fundamental changes in Israel’s political system:

The coalition agreements signal the birth of a "new Israel," one that is more extreme, racist and obscurantist and far removed even from the democracy that Israel used to claim for itself in front of Western societies. The agreement with Ben Gvir stipulates that he will take over the Ministry of Public Security with broad powers renaming it the "Ministry of National Security." It includes control over the Green Police, Green Patrols, the Law Enforcement Authority on the Territories, and the "Border Guard" unit operating in the West Bank, which is normally under the responsibility of the Central Command of the occupation army. It allows the establishment of a large national guard. His party holds the Ministry of Development of the Negev and the Galilee, to which was added “national immunity,” with an annual budget of 2 billion shekels. The Directorate of Planning under his party’s control is responsible for the "normalization" of settlements; i.e., placing them under the control of the various relevant ministries rather than the army and the defense ministry. The Ministry of Heritage is responsible for all archaeological sites in Israel, as well as those in the West Bank. It was also agreed to enact a law repealing the "disengagement" law and to legalize the settlement of Homesh, which was dismantled and recently returned to by settlers. Other settlements outposts will be legalized, including Avitar, located on Beita village, and more than 60 other outposts they call "Young Settlements" belonging to the "Hilltop Youth" gangs.

Then came the agreement with Smotrich's "Religious Zionism" party to take over as alternate finance minister, the Ministry of Immigration and Absorption and the Ministry of National Missions. A minister from his party will be placed at the Ministry of Defense and will be responsible for the Civil Administration as well as “Office of the Coordinator” in the Palestinian territories, the Settlement Brigade, the National Service and the Preparatory Schools for the army thereby removing them from the responsibility of the army. The minister in charge of all these missions will be in direct coordination with the prime minister. The party holds the chairmanship of the Special Committee on the Constitution, Law, the Judiciary and the Religious Service. He will also chair the Reform Committee that leads the judiciary reform.

Thus, Smotrich can in effect implement his annexation program by transferring the powers of the Civil Administration out of the Ministry of Defense to the civilian departments of the government, so that the settlements are placed outside the responsibility of the army and treated as areas located inside Israel. In this case, Israeli law would apply to them, which means a silent or "de facto" annexation that Smotrich urges. In other words, the settlement enterprise and creeping annexation will proceed at a rapid pace.

The coalition agreements that enabled Netanyahu to establish his government are tied to the enactment of new laws and the amendment of others, including basic laws. The so-called “Smotrich Law” allows him to separate the Civil Administration and supervise the settlers and the areas they occupy, i.e. a large part of Area C, from the Ministry of Defense and place them under his supervision and the responsibility of the Prime Minister. This could Include the appointment of the head of the Civil Administration and the head of the Coordination office.

The new laws and coalition agreements that inform the government's platform have significant implications for the nature of Israel's political system. The platform reflects an extreme racist ideology that rejects the idea of a political settlement. One of the most important paragraphs of the government's program states that “the Jewish people have an exclusive and unquestionable right to all areas of the Land of Israel. The government will promote and develop settlement in all parts of the Land of Israel — in the Galilee, the Negev, the Golan, Judea and Samaria." This provision does not at all observe the existence of the Palestinian people or any of their rights, does not abide by any agreement or any of the provisions or norms of international law, including those governing the role and powers of the occupying power. Instead, it will seek a silent de facto annexation of Jewish settlements in the West Bank. Nor does it care about the status of the Palestinian Authority (PA) or even the possibility of its collapse. It does not give weight to coordination with the PA or cooperation with it in solving problems on the ground. 

What would a Palestinian confrontational strategy look like?

The Israeli government's program and the coalition agreements that were implemented even before the government took the oath of allegiance in parliament do not allow any room for the Palestinians to cooperate with this government, appease it, or be patient with it. It has become clear that the Palestinians cannot deal with the new government like its predecessors or continue Palestinian-Israeli coordination. This government undermines all the foundations of Palestinian-Israeli relations and poses a threat to Palestinian national rights and interests.  It is natural that we should define our relationship with the Israeli Government on the basis of Palestinian interests. In this context, it seems only logical that we should be in a clash with this government. This conclusion is derived from the fact that the aggressive and destructive policies of the new government leave no room for any other alternative. The new government seeks to destroy all the foundations and possibilities of a peaceful solution and a political settlement of the conflict on the basis of the two-state solution on the borders of June 1967. We are in fact in a race against time. The changes that could occur on the ground, politically and legally, will be irreversible over time.

The inevitable confrontation with the Israeli government's policy and aggressive measures should take place within the framework of careful Palestinian planning and creative initiatives. It should go beyond the usual demands and appeals addressed to the international community and various other parties. We cannot afford to waste more time and maintain a waiting policy. We must take the initiative. Such an initiative should be built around the following ten steps that should constitute the Palestinian response to the new Israel.

First, we urgently need the Palestinian leadership in the PLO, and President Mahmoud Abbas in particular, as well as the leadership of Hamas, to take a definitive decision to begin the process of building national unity.  All Palestinian forces are required to agree on a joint program based on the demand of expelling the occupation and establishing an independent Palestinian state on the borders of June 1967.  Disagreement over tactical issues should have by now  narrowed to the farthest extent. Unity could begin by activating the PLO's “interim leadership” framework, which includes all factions as well as the PLO Executive Committee and some independents, to reassure Hamas that it is part of the unified political reaction of the Palestinian people until legislative elections are held and the Palestine National Council is reconstituted. A national unity government could be formed and it could start its work by preparing for general elections. In order to increase flexibility and create an atmosphere of trust between the various parties, the separation between the legislative and presidential elections may be acceptable to the Fatah leadership, meaning that no date is set soon for the election of the president, and to give a chance for unity within the framework of the legislative body and the government. This gradual unfolding of the election process is wise given the prevailing concern about the candidacy of Marwan Barghouti against President Mahmoud Abbas.

Second, we must break free from the shackles of Oslo, which no longer exists in the Israeli government's program. The announcement of the suspension of compliance with some of the obligations of Oslo that Israel cares about is consistent with the decisions of the Palestinian Central Council, such as the cessation of security coordination that has already been announced, which must be adhered to in full. Consideration should also be given to the transformation of the current PA, the one created by Oslo, to a PLO-led government of the State of Palestine in order to rehabilitate that organization, which must be reconstituted and activated as a result of a general election.

Third, we must call upon the Arab League to reemphasize the Arab Peace Initiative and to urge the Arab states to stop normalization with Israel in the light of its violation of international agreements. In this context, it is necessary to restore coordination and alliance relations with Arab countries within the framework of the League, with a special focus on influential Arab countries that are more closely tied to the Palestinian cause, such as Egypt, Saudi Arabia and Jordan, in order to ensure the return of Arab financial and political support for the Palestinian people. This component of the Palestinian initiative can be built on the tripartite summit held in Egypt between President Abdel Fattah Al-Sisi, King Abdullah II, and President Mahmoud Abbas on 17 January 2023. The Palestinian leadership must do everything possible to restore Arab solidarity and unify the Arab position in support of the Palestinian cause on the basis of the Arab Peace Initiative. Encouraging in this context is the Saudi position that rejects normalization with Israel as long as there is no real progress towards the establishment of an independent Palestinian state.

Fourth, the PA must embark a large-scale international diplomatic campaign to secure international recognition of the State of Palestine on the borders of June 1967. The real international response to Israel's annexation measures should be to confirm the recognition of the State of Palestine as a full member state under occupation and to stop unilateral Israeli measures in the occupied Palestinian territories. This should be taken in the context of the General Assembly resolution 19/67, which recognizes the State of Palestine as a non-member state of the United Nations. Security Council resolution 2334 sets a clear and unequivocal boundary between the occupied territories within the 1967 borders and Israel and considers everything Israel is doing in the occupied territories illegal and contrary to international law. This should be done despite the fact that UN resolutions remain unfortunately symbolic and do not rise to the level of actual pressure on Israel. It should be noted that some countries and private companies boycotted settlements based on such international decisions and resolutions. In this context, it is important to recruit support for this effort from the Palestinian and Arab diaspora communities.

Fifth, we should appeal to all international organizations concerned with the conflict, including human rights organizations, and focus in particular on the Human Rights Council, the International Court of Justice (ICJ) and the International Criminal Court (ICC), to issue political and legal positions against the Israeli occupation and its violations and to prosecute Israel and its political and security leaders for the crimes they commit against the Palestinian people.

Sixth, we must implement the decision of the Palestinian Central Council to freeze recognition of Israel and to link such recognition to an Israeli recognition of the right of our people to an independent state in the territories occupied since 1967, including East Jerusalem. Such a position represents an important moral step, a new political basis for dealing with the occupying authorities and a ground for future political negotiations. Most importantly, the Palestinian leadership must adapt to the difficult and painful reality that will most likely emerge, including enduring sanctions that Israel has begun to talk about simply for going to the ICJ to demand a legal advisory opinion on the continued Israeli occupation in the Palestinian territories.

Seventh, the Palestinian initiative should take advantage of the contradiction that has begun to appear in public between the position of the US administration and that of the new Israeli government. In particular, we should pay clear attention to the US warnings against any Israeli policy that may undermine the two-state solution and the US opposition to the policy of settlement expansion. This US position was evident in Secretary of State Antony Blinken's speech at the conference of the moderate Jewish organization, J Street, in Washington on 4 December 2022. We should also take note of the apparent contradiction between a large portion of the Jewish community in the US and the Netanyahu government on political matters related to annexation in the West Bank and on domestic issues related to religious imposition and undermining the foundations of democracy and liberalism in Israel. Moreover, we must work intensively in the American arena through those bodies in charge of the American file as well as the Palestinian, Arab and Islamic diaspora communities. We need to develop relations with the members of Congress of Palestinian and Arab descent to influence the position of the US Administration and Congress and provide mechanisms that could allow for American pressure on Israel, and in international forums.

Eighth, we should work intensively in the Israeli arena, capitalize on the unprecedented internal division in Israel, and coordinate intensively with the opposition to Netanyahu and the Palestinian citizens of Israel to contribute to the mobilization of the Israeli public opinion against the government and its policies. These policies pose a threat to the entire region, including Israel. The goal should be to generate popular pressure on the government to stop the process of annexation and settlement expansion. Twenty human rights organizations in Israel have warned against the annexation policy that the Israeli government intends to implement, out of interest in maintaining the State of Israel as a "Jewish" state, that is, with a large Jewish majority. Moreover, 10 Israeli organizations have expressed willingness to cooperate with international bodies to criminalize this Israeli annexationist policy.

Ninth, the Palestinian factions and popular forces must develop mechanisms and programs of large-scale non-violent popular resistance to allow for significant popular participation in hindering and disrupting the settlement program. We saw examples of this resistance in Beita and in the face of the threat of forced evacuation of Khan al-Ahmar and in the previous examples such as the village of Bab al-Shams. Since a majority of settlers comes to the occupied territories to obtain economic privileges, disrupting their daily life should be our goal. In this context, cooperation can be made with Israeli organizations that oppose the policy of annexation and settlement construction and support the rights of the Palestinian people.

Tenth, we should design a Palestinian development plan that aims at strengthening the steadfastness of the Palestinian citizens on their land, especially in Area C, which will be targeted more than ever. This plan should provide farmers and Bedouins with the means of resilience and survival, such as access to water, energy and animal feed. It should propose projects for land reclamation and cultivation, especially in the Jordan Valley, and provide financial incentives, whether by the government or international donors in cooperation with the government.

These are the main components of a Palestinian confrontational strategy based on on-ground activities as well as political and diplomatic offensives that seek to reshape the current relationship with the occupation authorities. The strategy aims to build on the PA decision to suspend security coordination. But it is not restricted to PA efforts. Factions, political parties, popular organizations, and civil society organizations, should join forces to carry out this national confrontational strategy.

مقدمة:

شكلت نتائج انتخابات مجلس الطلبة في جامعة بيرزيت التي جرت في ايار 2022 صدمة لدى مؤيدي ومناصري حركة فتح بعد الخسارة الفادحة التي منيت بها حركة الشبيبة الطلابية حيث حصلت على 18 مقعدا، من أصل 51 ، مقابل 28 مقعدا للكتلة الاسلامية و5 مقاعد للقطب الطلابي. كانت هذه النتائج صادمة لفتح لما للانتخابات الطلابية، وخاصة في جامعة بيرزيت، من أهمية لما تمثله في مسيرة الحركة الوطنية. وكانت صادمة لكون طلاب هذه الجامعة أكثر من غيرها من الجامعات يمثلون مختلف المناطق والطبقات والتيارات، ما يجعل الانتخابات فيها تعكس مؤشرًا عامًا لمواقف وسلوك الشباب الفلسطيني المتعلم. وفوق كل ذلك، فإن لجامعة بيرزيت أهمية خاصة في العملية الديمقراطية لأن هذه الجامعة شكلت منارة للعملية الديمقراطية بالمحافظة على تقاليد ديمقراطية طوال السنوات السابقة التي حُرم فيها الفلسطينيون من الانتخابات، حيث تعقد فيها الانتخابات بشكل سنوي الا في بعض السنوات نتيجة ظروف قاهرة وخاصة (العاميين 20/21، 21/22 نتيجة انتشار جائحة كورونا).  

جاءت هذه الانتخابات في ظل غياب شبه تام للحياة الديمقراطية عن الاراضي الفلسطينية منذ عام 2006 حينما جرت الانتخابات التشريعية، وكانت الانتخابات الرئاسية قد سبقتها بعام. وكانت قد جرت في وقت سابق من العام الحالي (اذار) ونهاية العام الماضي (كانون أول) انتخابات الهيئات المحلية في الضفة الغربية فيما تعذر اجرائها في قطاع غزة بسبب رفض حركة حماس السماح بذلك.

خلفية:

شهدت السنوات الخمس الماضية تقدما للكتلة الاسلامية على حساب منافستها الرئيسية، قائمة الشبيبة الطلابية، دون قدرتها على تشكيل مجلس الطلبة لوحدها، وفي الانتخابات التي سبقت اغلاق الجامعة بسبب جائحة كورونا كانت الشبيبة قد تساوت في عدد المقاعد مع الكتلة الاسلامية في الانتخابات التي جرت في 2019-2020. والشكل التالي يبين ذلك.

ومن الملاحظ أن الشبيبة فازت في جميع انتخابات بيرزيت التي جرت بعد سيطرة حماس على قطاع غزة حتى العام 2015؛ حيث حصلت الشبيبة في العام 2008 على 25 مقعدًا مقابل 19 مقعدًا للكتلة الاسلامية، وفي العام 2009 على 24 مقعدًا مقابل 22 للكتلة الاسلامية، كما حصلت في العامين 2010 و2011 على 31 مقعدًا و29 مقعدًا في ظل مقاطعة الكتلة الاسلامية للانتخابات خلال هذين العامين، وحصلت في العام 2012 على 26 مقعدًا مقابل 19 مقعدا للكتلة الاسلامية، وحصلت على 23 مقعدًا في العامين 2013 و2014 مقابل 20 مقعدًا للكتلة الاسلامية.[1]  وخلال العامين الذي قاطعت فيه الكتلة الاسلامية الانتخابات انخفضت نسبة المشاركة في الانتخابات من 85% في عام 2009 إلى 58% و50%، ومن ثم عادت للارتفاع مجددا لتصل الى 75% في العام 2012. ويلاحظ ان معظم الاصوات التي كانت تذهب للكتلة الاسلامية امتنعت عن الانتخاب، وأدى ذلك الى انخفاض الاصوات للمقعد الواحد من 117 صوتاً في 2009 الى 71 صوتاً في انتخابات 2010.[2]

فتحت نتائج انتخابات بيرزيت النقاش حول الأسباب وراء خسارة حركة فتح على الرغم من امتلاك الحركة قاعدة شعبية قد تكون الأكبر في الضفة الغربية، او على الأقل المتقاربة مع حركة حماس،  وذلك كما تشير نتائج استطلاعات الراي التي يجريها المركز الفلسطيني للبحوث السياسية والمسحية.[3] وهنا يبرز السؤال: كيف يمكن تفسير خسارة حركة فتح لهذه الانتخابات بهذا الفارق الكبير بالرغم من امتلاكها القاعدة الانتخابية الاكبر؟ 

تحاول هذه الورقة تسليط الضوء على الاسباب المختلفة لخسارة حركة الشبيبة الطلابية ولفوز الكتلة الاسلامية وتقديم التوصيات المناسبة لأطراف العمل السياسي ذوي العلاقة بهذه النتيجة.

النتائج واسبابها:

تنحصر خسارة حركة الشبيبة الطلابية وفوز الكتلة الاسلامية بمجموعة من الاسباب، أبرزها التالية:

  1. أخطاء السلطة الوطنية الفلسطينية
  2.  أخطاء حركة فتح
  3.  مشاكل داخل الشبيبة الطلابية
  4. قوة جذب حركة حماس
  5. تدخلات الاحتلال الإسرائيلي يخدم المعارضة للسلطة

 

1) أخطاء السلطة الفلسطينية

قامت السلطة الفلسطينية خلال الاعوام الماضية باتخاذ مجموعة من الإجراءات التي أضرت بطبيعة نظام الحكم الذي كان القانون الأساسي ومجموعة أخرى من القوانين الرئيسية قد أرسته في فلسطين. فقد تم إلغاء المساءلة والمراقبة على عمل الرئيس والحكومة، وأُضعفت السلطة القضائية وهُدد استقلالها.[4] وقد شهد العام السابق لانتخابات بيرزيت عدة أحداث ساهمت في خسارة الشبيبة منها تأجيل الانتخابات العامة (التشريعية والرئاسية) والتي كان من المقرر اجرائها في ايار وتموز من العام الماضي 2021، وموضوع لقاحات فايروس كورونا وما شابها من لغط، ومقتل الناشط نزار بنات اثناء اعتقاله من قبل اجهزة الامن الفلسطينية، اضافة لتقرير ديوان الرقابة المالية والادارية حول صندوق وقفة عز، ومستشفى خالد الحسن لأمراض السرطان، وغير ذلك من القصص الاشكالية التي شغلت الرأي العام الفلسطيني.  هناك اجماع شبه تام، سواء من قبل الطلاب او أساتذة الجامعة او الجمهور بشكل عام او والخبراء في الأوضاع السياسية الفلسطينية، ان سلوك السلطة السيء والانطباعات عنه كان السبب الرئيسي في خسارة حركة فتح.[5] يجمع طلاب الجامعة الذين أجريت معهم مقابلات (14 مقابلة) خاصة بهذا الموضوع، وهم من مختلف الأطر الطلابية، ان سبب الخسارة للحركة هو سلوك السلطة ومعاقبة الطلاب للشبيبة الطلابية على سلوك السلطة. تقول احدى طالبات جامعة بيرزيت ممن صوتوا للكتلة الاسلامية إن السبب الرئيسي لتفوق الكتلة الاسلامية هو الربط بين أفعال السلطة السيئة في الآونة الأخيرة، مثل مقتل نزار بنات وغيرها، وبين حركة الشبيبة. وتقول طالبة أخرى إن هذا التحول في مواقف الطلاب لم يحدث في سنوات سابقة لأن إجراءات السلطة السيئة زادت بشكل ملحوظ، كما أن وعي الطلاب على هذه الإجراءات أصبح اكبر بكثير من خلال وسائل التواصل الاجتماعي ومجموعات الطلبة المنظمة التي أصبحت اكثر فعالية ونشاط مقارنة بالسنوات السابقة.  وتقول طالبة جديدة في الجامعة إن الطلاب داخل الجامعة لا ينظرون بشكل رئيسي لنشاطات الكتل داخل الجامعة ولكن ينظرون الى الوضع السياسي في الخارج، وبما ان السلطة واجراءاتها وخاصة في الفترة الأخيرة تعطي انطباعاً سيئاً لدى الطلاب فقد أدى ذلك الى عدم التصويت للشبيبة.

وتقول احدى الطالبات ان السبب الرئيسي في فوز الكتلة الإسلامية هو أفعال السلطة والتوجه العاطفي لدى الطلاب لمعاقبتها وهم يعتبرون ان فتح هي السلطة، وبالتالي لم يصوتوا لفتح رغم أن الكثير من الطلاب الذين نعرفهم ينحدرون من أسر جميعها مؤيدة لفتح ولكنهم صوتوا لحماس بسبب موقفهم من السلطة.

كما يؤكد ذلك أساتذة الجامعة الذين شهدوا الانتخابات خلال سنوات مختلفة. فمثلا، تقول د. مي، وهي محاضرة في جامعة بيرزيت وكانت قد درست البكالوريوس والماجستير في جامعة بيرزيت (أي انها عاشت في الجامعة كطالبة ومحاضرة). إنه لا شك أن هذه الطفرة في نتائج الانتخابات جاءت كعقاب لسلوكيات السلطة انعكس على حركة فتح وبالتالي على الشبيبة في الجامعة.

كما ان اغلبية من الجمهور الفلسطيني تنظر لحركة الشبيبة من نفس المنظور. أظهرت نتائج استطلاع للرأي العام أجراه المركز الفلسطيني للبحوث السياسية والمسحية بعد ظهور نتائج انتخابات جامعة بيرزيت أن 59% يرون أن سبب فوز الكتلة الاسلامية هو احتجاج من الطلاب على اداء السلطة الفلسطينية، فيما يرى 32% من الجمهور الفلسطيني أن سبب الفوز هو تحول لدى الشعب الفلسطيني نحو المزيد من تأييد حماس.[6] ترتفع نسبة من يعتقدون ان فوز الكتلة الاسلامية يعود لسوء أداء السلطة بين من سيصوتون لحركة فتح في انتخابات تشريعية لو حصلت اليوم حيث يقول 70% منهم بذلك، كما يوضح الشكل التالي.

من المفيد في هذا السياق النظر في مواقف الشباب الفلسطيني عموما من السلطة الفلسطينية. تشير نتائج آخر استطلاعات المركز الفلسطيني للبحوث السياسية والمسحية والتي أجريت قبل انتخابات بيرزيت الى ان مواقف الشباب تجاه العديد من القضايا التي تقيم أداء السلطة، والتي تنعكس بدورها على حركة فتح وحجم التأييد لها، هي مواقف لا تصب في مصلحة الحركة. تبدي الأغلبية الشبابية عدم الرضى او الاستياء من أداء السلطة مما ينعكس غالبا على التأييد للحركة او لأطرها المختلفة مثل مجالس الطلبة وغيرها. فمثلا، يظهر الجدول أدناه ان 86% من الشباب يعتقدون بوجود فساد في أجهزة السلطة، و73% يرون ان الناس لا يستطيعون انتقاد السلطة بدون خوف، و64% غير راضيين عن أداء الرئيس محمود عباس، و57% لا يحبذون بقاء الرئيس عباس في السلطة.

2) أخطاء حركة فتح

افتقدت حركة فتح لرؤية واستراتيجية لكيفية التعامل مع الشبيبة كقطاع شبابي يمثل مستقبل الحركة، فقد هدفت الحركة ان تكون الشبيبة ملحقة بالحركة وداعمة لها ولقياداتها. وافتقدت الحركة لبلورة رؤية لدور الشبيبة في مواجهة الاحتلال، وهذه واحدة من أكبر اهتمامات الطلاب والشباب. بل افتقدت لبلورة رؤية تتعامل مع القضايا الحياتية التي تخدم المجتمع بشكل عام. فدائما كان التفكير في كيفية خدمة الشبيبة للجسم الرسمي للحركة دون مراعاة لخصوصية الشبيبة التي يجب ان تتمايز عن الحركة الام، خاصة انها تمثل قطاع الشباب الذي له رؤيته المختلفة للعديد من القضايا المختلفة. [7]

ساهمت المواقف الرسمية التي اتخذتها حركة فتح، مثل دعمها المطلق للسلطة وعدم القدرة على التمايز في المواقف في كثير من الحالات، في خسارة الشبيبة. وهنا يبرز مرة اخرى حادث مقتل نزار بنات عندما استنفرت حركة فتح قواعدها وأنزلتهم للشوارع للدفاع عن السلطة في مواجهة مواطنين فلسطينيين محتجين في سابقة خطيرة جعلت من حركة فتح تساهم في الاعتداء على الحريات، بدلا من الدفاع عن الحريات، وفي الاعتداء على غيرها من القيم الديمقراطية التي صاغتها فتح في أدبياتها، والتي كرستها بتجربتها في الجامعات والسجون. بل إن الحركة عزلت منسق الشبيبة والهيئة التنظيمية العاملة معه في الجامعة لقيام الشبيبة في جامعة بيرزيت بإصدار بيان يدين مقتل الناشط نزار بنات ويرفض القمع وتقييد الحريات. تقول احدى الطالبات أن حماس ركزت نشاطاتها قبل الانتخابات بفترة قصيرة على الوضع الخارجي وممارسات السلطة، وخاصة قضية نزار بنات، حيث استغلت بعض الصور لأفراد من كتلة الشبيبة شاركوا في المسيرات التي خرجت ضد المواطنين المعارضين وقد لاقى دور الشبيبة هذا استياءً كبيرا بين الطلاب.

فوق كل ذلك، افتقدت حركة فتح خلال السنوات الماضية للخطاب "الثوري" الذي يتبناه المنافس السياسي للحركة، أي حركة حماس، علما ان حركة فتح اكتسبت معظم القاعدة الشعبية لها في ستينات وسبعينات القرن الماضي نتيجة لذلك الخطاب والفعل "الثوري" الذي تبنته ومارسته الحركة في تلك الفترة الماضية. يعتبر طلاب الجامعات من أكثر الفئات العمرية راديكالية، وبالتالي فان الخطاب "الثوري"، وخاصة المقاوم للاحتلال، هو أكثر ما يشد هؤلاء الطلاب ويعبئهم. فقد أظهرت استطلاعات الرأي العام أن أغلبية تبلغ 55% من الشباب تعتقد أن العمل المسلح هو الطريقة الأفضل لتحقيق الأهداف الفلسطينية في إنهاء الاحتلال واقامة دولة مستقلة، وهي بالطبع الطريقة التي لا تتبناها السلطة الفلسطينية، مقابل 14% فقط من الشباب يرون أن المفاوضات هي الطريقة الأفضل لتحقيق الاهداف الفلسطينية بإنهاء الاحتلال واقامة دولة مستقلة.

3) مشاكل داخل الشبيبة الطلابية

 

هناك مجموعة من الاسباب وراء الهزيمة تتعلق بعمل وسلوك الشبيبة الطلابية في جامعة بيرزيت تتمثل فيما يلي:

  • قبول الشبيبة الطلابية أن يكونوا ملحقين وتابعين للحركة دون أي تمايز في المواقف: ففقدت الشبيبة في جامعة بيرزيت دورها القيادي الذي طالما تميزت فيه، خاصة في المرحلة التي أصبح يتم فيها تعيين المنسق والهيئة التنظيمية داخلها بدل انتخابه.[8] تقول احدى طالبات جامعة بيرزيت ممن صوتوا للكتلة الاسلامية ان السبب الرئيسي لتفوق الكتلة ليس فقط الربط بين أفعال السلطة الفلسطينية السلبية في الآونة الأخيرة وبين حركة الشبيبةـ، بل لأن بعض أفراد حركة الشبيبة كانوا يعززون هذا الربط من خلال محاولتهم الدفاع عن السلطة وإجراءاتها، مما عزز ذلك الربط عند الطلاب وبالتالي جاءت النتيجة كعقاب للسلطة من خلال انتخاب الكتلة الإسلامية.[9]
  • غياب النشاطات المنظمة والتعبئة لدى الشبيبة مقارنة بما تقوم به حركة حماس: تقول إحدى الطالبات في تفسيرها لتفوق الكتلة الإسلامية ان الامر متعلق ايضا بالنشاطات الطلابية داخل الجامعة من قبل حركة الشبيبة والكتلة الإسلامية حيث إنه على الرغم من كثرة النشاطات التي قامت بها حركة الشبيبة إلا انها كانت متباعدة وغير منظمة وغير ملموسة بشكل قوي من قبل الطلاب. في المقابل ركزت الكتلة الإسلامية نشاطاتها قبل الانتخابات بفترة قصيرة وكانت منظمة وركزت على الوضع الخارجي وافعال السلطة.
  • الخلافات الداخلية القائمة احيانا على اسس جغرافية ومناطقية بين ابناء الشبيبة والظاهرة لبقية الطلاب: فهي اولا تضعف الشبيبة وتبعد الاخرين عنها، فالتنظيم غير القادر على ترتيب اموره الداخلية سيكون أضعف من منافسه في عملية استقطاب الطلبة، خاصة في ظل وجود منافس سياسي يسعى لاستغلال اخطاءك.[10]
  • عدم القدرة على تقديم الافضل للطلاب من خلال برنامج نقابي مهني قادر على استقطاب الطلاب: يقول العديد من الطلاب أن الشبيبة تفتقر لبرنامج نقابي يعالج حاجاتهم الجامعية. بل يقولون إن المنافس الرئيسي الثالث، أو القطب الطلابي، هو الأنجح في عرض برامج نقابية مقبولة.[11]
  • غياب الحياة الديمقراطية عن عمل الشبيبة في جامعة بيرزيت قبل الانتخابات: كما أشرنا سابقا، أصبح يتم تعيين قيادة الشبيبة من خلال قيادة الحركة، وقد تكون هناك انتخابات مصغرة، وليس من خلال مؤتمر عام يشارك فيه كل ابناء الشبيبة لاختيار قيادتهم كما جرت العادة طوال سنوات العمل الطلابي في جامعة بيرزيت.[12] يؤدي هذا السلوك لزيادة عدد الغاضبين والناقمين من أبناء الشبيبة ما يجعلهم غير مكترثين بنجاحها، وقد يعمل بعضهم على إفشالها. وكان هذا أحد أهم التحديات التي واجهت حركة الشبيبة في الجامعة، أي كيف تسوق نفسها على انها حركة ديمقراطية وهي لا تمارس العمل الديمقراطي في عملها التنظيمي الداخلي.  لكن الحركة تداركت هذا الموضوع بعد الانتخابات وتم انتخاب منسق للشبيبة الطلابية، جرى اعتقاله من قبل الاحتلال لاحقاً.

 

4)  قوة جذب حركة حماس

تسيطر حركة حماس على قطاع غزة منذ حزيران 2007، وقد ساهمت سيطرتها هذه في انخفاض شعبيتها منذ تلك السنة وحتى عام 2015، الا في فترات قصيرة أثناء الحروب الاسرائيلية على قطاع غزة. وقد بدأت حماس تستعيد شعبيتها نتيجة قيام السلطة باتخاذ مجموعة من الاجراءات التي تم الاشارة لها سابقا، وذلك بالرغم من أن حركة حماس لا تقدم نموذجا أفضل في الحكم من حركة فتح.  فهي تمنع الحياة الديمقراطية في قطاع غزة حيث لم يتم اجراء أية انتخابات محلية، كما جرى أكثر من مرة في الضفة الغربية، ولا تسمح بإجراء الانتخابات الطلابية في الجامعات الفلسطينية الموجودة في قطاع غزة، وتتدخل في الانتخابات النقابية فتسمح بهذا وتمنع غيره. وقد ساهم قمع حكومة حركة حماس في قطاع غزة لحراك "بدنا نعيش" في عام 2019 في خسارة تفوق الكتلة الاسلامية في جامعة بيرزيت وحصولها على عدد من المقاعد مساوي لعدد مقاعد الشبيبة في انتخابات مجلس الطلبة في ذلك العام، بل كان التفوق في عدد أصوات الطلاب لصالح الشبيبة بحوالي 68 صوت.[13]

لكن حركة حماس حافظت على خطابها السياسي المنادي بمقاومة الاحتلال من خلال جميع انواع المقاومة وفي مقدمتها العمل المسلح، حيث خاضت في أيار 2021 حربا مع الاحتلال الاسرائيلي بسبب التعديات والاجراءات الاسرائيلية في مدينة القدس. ساهمت تلك الحرب في رفع شعبية الحركة بصورة واضحة، وهذا ما اظهرته الاستطلاعات قبل وبعد الحرب.[14]

5) تدخلات الاحتلال الإسرائيلي تخدم المعارضة للسلطة

قامت قوات الاحتلال الإسرائيلي بحملة اعتقالات بحق عدد من ناشطي ومرشحي الكتلة الاسلامية في الجامعة قبل الانتخابات بأيام. يعتقد عضو المجلس الثوري لحركة فتح، حسن فراج، أن هذا التدخل من قبل الاحتلال يساعد من زيادة حجم التعاطف مع طلاب الكتلة الاسلامية وبالتالي ينعكس على التوجه الانتخابي للطلبة. وكانت قوات الاحتلال قد اعتقلت عددا من المرشحين المحسوبين على حماس في آذار/مارس 2022. ويضيف فراج أن عمليات الاعتقال هذه تخلق تعاطفا مع من تم اعتقالهم من قبل الاحتلال.[15] وهذا ما أيده عدد من الطلبة، سواء ممن انتخبوا الشبيبة او الكتلة الإسلامية، حيث جزموا بأن الاعتقال من قبل الاحتلال يساهم في زيادة شعبية المعتقل.

 

التوصيات:

خرجت الدراسة بمجموعة من التوصيات للسلطة الفلسطينية وحركة فتح وحركة حماس والشبيبة الطلابية في جامعة بيرزيت.

توصيات للسلطة الفلسطينية:

  • عدم التدخل في الانتخابات الطلابية وغيرها من شؤون الطلبة، وخاصة من قبل الأجهزة الامنية الفلسطينية، لأن ذلك ينعكس سلبا على النتائج في ظل رفض الطلبة لهذه التدخلات.
  • المحافظة على العملية الديمقراطية في بقية الجامعات والنقابات وتشجيع عقد الانتخابات في المواقع التي لا يوجد فيها انتخابات.

توصيات لحركة فتح:

  • وقف التدخل من قبل قيادة الحركة في حركة الشبيبة واعطائهم المساحة اللازمة لإنجاح عملهم وقيامهم بدورهم النقابي، فهؤلاء الطلاب هم قادة المستقبل.
  • إعادة صياغة برنامج وطني يعيد ترتيب الحالة الوطنية وكل ما يتعلق بالمواجهة مع الاحتلال، واستعادة حركة فتح لدورها القيادي في العمل الوطني والمواجهة مع المحتل.
  • تبني مواقف أقرب للمواطن في القضايا الوطنية واليومية المتعلقة بحياة الناس بحيث تكون متمايزة عن مواقف السلطة.
  • إعادة صياغة حركة فتح وبنائها من خلال عقد مؤتمر عام لحركة فتح بشكل نزيه وعادل يقوم على اسس ديمقراطية حقيقية وتمثيل حقيقي لكافة قواعد حركة فتح، وبحيث يكون هذا المؤتمر قادرا على انتخاب قيادة للحركة تعيد تقييم المرحلة السابقة والاستفادة من الاخطاء السابقة واخذ العبرة منها.

توصيات لحركة حماس:

  • السماح بإجراء الانتخابات بشكل منتظم في الهيئات المحلية والجامعات والنقابات والاتحادات الشعبية والجمعيات الخيرية والأهلية وغيرها، وإعطاء المزيد من الحريات للفعاليات والاحتجاجات المخالفة بالرأي، والمضي نحو تمكين الناس من اختيار ممثليهم في هيئاتهم المحلية والطلابية والنقابية. فمن غير المعقول ان تتغنى حماس بانتصاراتها في جامعات الضفة الغربية وهي تمنعها وتضيق على الحريات في قطاع غزة.

توصيات للشبيبة الطلابية:

  • المضي قدما بتعزيز الديمقراطية الداخلية في حركة الشبيبة والاستمرار في اجراء الانتخابات الداخلية كما حصل مؤخرا بعد الخسارة حيث جرى انتخاب قيادة الشبيبة من قبل طلاب الشبيبة في الجامعة.
  • محاربة اي ظواهر سلبية داخل الشبيبة مثل المناطقية والفئوية والتي تؤدي لتفريق الجهود وتشتيت الاصوات.
  • عدم تبني مواقف السلطة غير المقبولة شعبيا او الدفاع عنها من قبل افراد الشبيبة

Introduction:

The results of the student council elections at Birzeit University that took place in May 2022 came as a shock to supporters of Fatah after the heavy loss suffered by its student youth movement, al Shabiba, winning only 18 seats out of 51, compared to 28 seats for the Islamic Bloc, Al Kutlah al Islamiyyah, and 5 seats for the Student Pole, al Qutb al Tollabi, that represents leftist forces at the university. These results were shocking to Fatah because of the importance of the student elections, especially at Birzeit University, for what they represent for the future of the national movement. It was shocking because the students of this university, more than other university in the West Bank, represent many of the various regions of the West Bank as well as the various socio-economic classes and political currents thereby making the Birzeit elections a barometer of the attitudes and behavior of the educated Palestinian youth. Birzeit University has a special importance in the democratic process because this university has been a beacon of democratic practices preserving democratic traditions throughout the previous years in which Palestinians were deprived of national elections, while student elections were held annually at that university except in the most difficult conditions, such as the Covid pandemic in 2020 and 2021.

These elections came amid the near-total absence of democratic life in the Palestinian territories as no national elections have been held since 2005 and 2006, when presidential and legislative elections were held respectively. Back in December 2021 and earlier this year, in March 2022, local council elections were held in the West Bank, but they were not held in the Gaza Strip because of Hamas' objection to holding them in that part of the Palestinian territories

 

Background:

The past five years have witnessed a strong showing by Hamas’ Islamic Bloc at the expense of its main rival, al Shabiba, but without gaining a majority of Birzeit student vote. In the elections that preceded the closure of the university due to the Corona pandemic, in 2019-2020, al Shabiba was in fact able to win the same number of seats as the Islamic Bloc. The following figure shows the seat distribution at Birzeit University during the period between 2016-2022.

It should be noted that al Shabiba won all Birzeit University student elections that took place between 2007 and 2015, i.e., after Hamas violently took control of the Gaza Strip.  For example, in 2008 it won 25 seats compared to 19 seats for the Islamic Bloc; in 2009 it won 24 seats compared to 22 for the Islamic Bloc; in 2010 and 2011 it won 31 seats and 29 seats respectively while the Islamic Bloc boycotted the student elections; in 2012 it won 26 seats compared to 19 seats for the Islamic Bloc; in 2013 and 2014 it won 23 seats compared to 20 seats for the Islamic Bloc.[1]  During the two years that the Islamic Bloc boycotted the elections, the student turnout fell from 85% in 2009 to 58% and 50% respectively before rising again to 75% in 2012. Most of the votes that used to go to the Islamic Bloc abstained, resulting in lowering the number of votes required per seat from 117 in 2009 to 71 in the 2010 elections.[2]

The results of the Birzeit University student elections have opened the debate about the reasons behind Fatah's loss despite the group's greater popularity in the West Bank compared to that of Hamas as indicated by the most recent public opinion polls.[3] How can Fatah's loss by such a large margin be explained despite having such a great electoral base?

Explaining Fatah’s loss and Hamas’ victory

The loss of al Shabiba and the victory of the Islamic Bloc can be attributed to a number of reasons, the most prominent of which are the following five:

  1. Mistakes and blunders made by the Palestinian Authority (PA) during 2021
  2. Mistakes made by Fatah
  3. Internal problems within al Shabiba
  4. Hamas remains attractive to the youth
  5. Israel unintentionally helped Hamas

1. PA blunders and poor performance:

Over the past few years, the PA has taken a series of measures that have harmed the nature of the system of government that the Basic Law and another set of key laws had established in Palestine. Accountability and oversight over the work of the president and government have been abolished and the judiciary has been weakened and its independence threatened.[4] The year before the Birzeit University elections witnessed several events that contributed to al Shabiba’s loss including the postponement of the general elections (legislative and presidential) that were scheduled to be held in May and July 2021, the perceived PA mismanagement of the import of the coronavirus vaccines, and the killing of activist Nizar Banat during his arrest by the Palestinian security services. Public concern about corruption within the PA has been aggravated by the release of various reports including that of the Office of Financial and Administrative Control on the Ezz Waqf Fund and on Khalid Al-Hassan Hospital for Cancer Diseases.

There is considerable agreement among those interviewed for this Brief, among students, university professors, the public at large, or experts on the Palestinian political scene, that the PA's blunders and unpopular behavior were the main reasons for Fatah's loss. In-depth interviews with 14 Birzeit university students from different student political currents show that all of them agree that this has been the top most important factor shaping the outcome of the student elections: the students punished al Shabiba for the “crimes” of the PA.[5] One Birzeit University student who voted for the Islamic bloc says that the main reason for the Bloc's popularity is the link made by the students between the PA’s recent actions, such as the killing of Nizar Banat, and al Shabiba. Another student says that this shift in student attitudes did not occur in previous years because the magnitude of PA plunders in recent years has been unprecedented and the student awareness of these plunders has become much greater thanks to social media and the emergence of organized student groups, on WhatsApp and other platforms, that became much more active and effective compared to previous years.  A new student at the university says that new students do not mainly look at the activities of the student blocs inside the university but rather look at the political situation in the country, and since the PA’s behavior has worsened in recent years, student perception of the PA is becoming overwhelmingly negative.  Another student says that the main reason for the victory of the Islamic bloc is the great urge among the students to send a message to the PA and Fatah by voting against al Shabiba despite the fact that many of those students come in fact from Fatah affiliated families.

These findings are confirmed by university professors who witnessed various election rounds during past years. Reflecting the views of many, one lecturer at Birzeit University, who studied her bachelor's and master's degrees at the same university, asserted that Hamas’ victory was essentially a punishment for the PA and Fatah.

It is also the sentiment of the Palestinian public. The results of a public opinion poll conducted by the Palestinian Center for Policy and Survey Research right after the Birzeit University elections showed that 59% believe that the reason for the victory of the Islamic Bloc is a protest by students against the performance of the PA, while 32% of the Palestinian public believe that the reason for the Islamic Bloc victory is a shift among the Palestinian people towards greater support for Hamas.[6] But as can be seen in the following figure, while 70% of the likely Fatah voters think the vote for the Islamic Bloc was a punishment for the PA rather than a reward for Hamas, only 22% of likely Hamas voters think agree with that statement.

In this context, it is useful to consider the attitudes of Palestinian youth in general towards the PA. The results of the latest polls conducted by the Palestinian Center for Policy and Survey Research conducted before the Birzeit elections indicate that the youths’ perception of the PA performance is highly negative. This negative perception leaves its impact on Fatah as well thereby reducing public support for it. As Figure (3) below indicates, the majority of 86% of the youth believes in the existence of corruption in PA institution, 73% think people cannot criticize the PA without fear, 64% are dissatisfied with the performance of president Abbas, and 57% want the president to resign.

2. Mistakes made by Fatah:

Fatah seems to lack a vision and strategy for how to deal with al Shabiba as a youth sector that represents its future. The movement seems to want to make its youth group a subordinate rather than a partner. It provides no guidelines for how the youth should relate to the Israeli occupation, a topic of the utmost importance to students and young people in general. To make things worse, Fatah lacks a clear vision on how to organize Palestinian society and deal with the day to day living conditions. Fatah’s failure in allowing its youth movement to develop its own national vision denies al Shabiba the ability to take the initiative and press the national leadership in the direction most favored by Palestinian youth.[7]

On top of that Fatah finds itself unable to distinguish itself from the PA, to the contrary, it provides full support to PA policies including those rejected by the overwhelming majority of the public. The example most cited by students and others is the manner in which Fatah dealt with the killing of Nizar Banat. Instead of distancing itself from the incident, Fatah mobilized its base and brought it to the streets to defend the PA in the face of public anger. This episode served as a dangerous precedent portraying Fatah as a party that assaults liberties and freedoms, rather than defending them, in total contradiction with Fatah’s values enshrined in its literature. Worse yet, Fatah dismissed its own Shabiba coordinator at Birzeit University and the organizing body working with him because the group issued a statement condemning the killing of Banat and rejecting repression and restrictions of freedoms. One student said that shortly before the elections, the Islamic Bloc focused its campaign on this and similar incidents to demonstrate how al Shabiba was no longer representing the aspiration of the youth and that, to the contrary, it was being used by the PA as a local militia to crack down on non-violent protests by the Palestinian civilians. Hamas distributed photos showing how Birzeit students from al Shabiba were taking part in counter demonstrations defending with the PA and its security officers. Reaction by the students to these images were decidedly negative generating a great deal of resentment against their own colleagues at the university.

Above all, Fatah has over the past years lacked the "revolutionary" discourse adopted by the movement's political rival, Hamas. Given the fact that Fatah has gained most of its popular base in the sixties and seventies of the last century as a result of its "revolutionary" discourse and action adopted and practiced by the movement in that past period. University students are considered to be among the most radical age groups in Palestinian society, one that most likely finds itself highly attracted to the "revolutionary" discourse that Fatah has now abandoned. PCPSR public opinion polls have shown, as indicated in the Figure (4) below, that a majority of 55% of the youth believe that armed struggle is the best means to achieve Palestinian goals of ending the occupation and establishing an independent state compared to only 14% of the youth who believe that negotiations are the best means. This of course is not the position adopted by the PA or the Fatah movement.

3. Al Shabiba’s internal problems:

Al Shabiba made its own significant contributions to its defeat. The following problems characterized the group’s behavior at Birzeit University in the months and years before the latest elections and doomed its chances of winning:

  • Al Shabiba accepted to subordinate itself to the Fatah movement without any attempt to differentiate its position from that of the larger political movement: Al Shabiba at Birzeit University lost the leadership role when it acceded to interferences from Fatah in its internal affairs, for example by allowing it to appoint, rather than elect, the group’s coordinator and organizational body, thus subordinating itself to that of the larger movement.[8] One Birzeit University student, who voted for the Islamic Bloc, says that on top of existing links between al Shabiba and the PA, the group was in no position to declare any dissenting views because it was fully controlled by its mother organization, Fatah. In toeing the line, al Shabiba, therefore, had no choice but to threw its full weight behind the PA plunders, regardless of how distasteful and unpopular they were. With this in mind, students had no choice but to vote for its rival, the Islamic Bloc.[9]
  • The absence of Al Shabiba organized activities and mobilization campaigns among the students compared to that of Hamas: One student says in her explanation of the advantage the Islamic Bloc had that while al Shabiba’s student activities were ad hoc and lacked consistency, the Islamic Bloc was much more organized and active in organizing student activities.
  • Visible internal disagreements existed within al Shabiba’s own ranks and were based on geographical and regional bases: Conflicts within the ranks of al Shabiba were perceived by other students are evidence of discrimination practiced by the group against certain groups and geographic areas rather than disagreements based on an open exchange of ideas and genuine disagreements over policies. These perceptions turned students off and led them to stay away from the group.[10]

 The failure of al Shabiba to act as a professional student union: Students expect their syndicate or union to aggregate their interests and protect them in negotiations with the university administration. Some students felt that, on occasions, al Shabiba failed to do that. They stressed that to be successful al Shabiba needed to pay greater attention to the needs of the students, as students, by helping to create an environment conducive to learning and scholarship.  Indeed, many say the Student Pole, a rival, was the most successful in promoting pro student programs.[11]

  • The absence of democratic practices within al Shabiba at Birzeit University: As indicated earlier, the leadership of al Shabiba before the latest student elections was appointed by the Fatah leadership. While some limited forms of mini elections continued to be seen in its activities, the group has stopped its previous practice in which its entire leadership was elected by a general conference of all members.[12] This lack of democratic practices has generated disappointment among the students, including among its own ranks, leading to indifference regarding the outcome of the student elections. Al Shabiba could not sell itself to the students as a democratic movement when it shunned democratic practices within its own ranks. It is worth noting that the election defeat forced Fatah to reevaluate its policy and to allow al Shabiba to hold its own elections; indeed, a new coordinator was elected but was soon arrested by the Israelis.

4. Hamas remains attractive:

Hamas has controlled the Gaza Strip since June 2007, and its control has contributed to a decline in its popularity for the following 8 years, until 2015, except for short periods during its armed confrontations with Israel. Despite the fact that Hamas does not offer a better model of governance than Fatah, it did manage to regain popularity as a result of a series of measures adopted by the PA and referred to earlier. Hamas prevents any democratic life in the Gaza Strip, where no local elections have been held, as has been done more than once in the West Bank. It does not allow student elections to be held in Palestinian universities located in the Gaza Strip. It interferes in trade union elections, allowing some and preventing others. The repression by the Hamas government in the Gaza Strip of the Bedna Neish (We Want to Live) movement back in 2019 contributed to the loss of the Islamic Bloc's popularity at Birzeit University. In that year, al Shabiba won more student votes than the Islamic Bloc.[13]

However, Hamas has been able to capitalize on its rhetoric regarding the resistance to occupation and the fact that it did engage in repeated armed confrontations with the Israeli army at a time when the Palestinian-Israeli peace process, championed by the PA, was dead and buried. The May 2021 war between Israel and Hamas led to a major spike in that movement’s popularity that benefited its student group, the Islamic Bloc. Within three months, Hamas managed to increase its popularity by one third as can be seen in the following figure.[14]

5. How Israel, inadvertently, helps Hamas:

Days before the elections, the Israeli occupation forces carried out a series of arrests against a number of activists and candidates of the Islamic Bloc at the university. Hassan Farraj, a member of Fatah's Revolutionary Council and the person in charge of al Shabiba in the movement, believes that this interference by the occupation helps to increase the level of sympathy for the students of the Islamic Bloc and thus impacts the electoral preferences of the students. Farraj adds that these arrests create sympathy for those arrested by the occupation.[15] This was supported by a number of students, those who voted for al Shabiba and those who voted for the Islamic Bloc, who asserted that the arrests by the Israeli army contributes to increasing the popularity of the detainees and their student faction.

 

Recommendations:

The loss of al Shabiba and the victory of the Islamic Bloc can be attributed to a number of reasons, the most prominent of which is the mistakes and blunders made by the PA during 2021. Fatah and al Shabiba made their own mistakes as well; and Hamas was able to capitalize on its increased popularity in the aftermath of its May 2021 war with Israel.

The study concludes with a set of recommendations for the Palestinian Authority, Fatah, Hamas, and al Shabibah at Birzeit University.

 

To the PA:

  • A policy of no-interference in student elections, as well as other student matters, especially by the Palestinian security services, is recommended. Such interference, when it occurs, reflects negatively on the results in light of the students' rejection of this PA behavior.
  • It is recommended that the PA maintain the democratic process in the rest of the universities and unions and encourage the holding of elections in locations where they are not held.

To Fatah:

  • The most important recommendation to Fatah is similar to the one made to the PA: stop the interference in the affairs of al Shabiba; give your youth the necessary space to make their own decisions and to act as a trade union serving the interests of its student base.
  • Fatah should also reformulate its national program to be in sync with the national sentiments. For Fatah youth to win, they need to be seen as part of a leading movement engaged in the national struggle for liberty and freedom.
  • Similarly, Fatah needs to be seen by the students as a movement in tune with the pulse of the public on local matters even if that means having distinctly different views than those of the PA.
  • In particular, Fatah needs to reestablish its democratic credentials by holding its General Congress and electing its leadership in elections that are free of fear and intimidation with full representation to all sectors of its base.

To Hamas:

  • The single most important recommendation to Hamas is to allow elections to be held regularly in local bodies, universities, trade unions, civil associations, etc., and allow more freedoms to dissenting activities and protests, and enable people to elect their representatives in their local councils. It is inconceivable that Hamas would pay tribute to its victories in West Bank universities while preventing elections and restricting freedoms in the Gaza Strip.

To the Shabiba:

  • The single most important recommendation to al Shabiba is to move forward with strengthening its internal democratic practices and to hold internal elections for its bodies, as happened recently after the Birzeit University loss where its youth leadership was elected by the students.
  • It should combat all negative phenomena within its ranks, such as regionalism and factionalism that lead to apathy, the dispersal of efforts, and the dispersal of votes.
  • It should not embrace or defend unpopular PA policies as its own; as a youth movement it should strive to encourage critical thinking and open discussion of unpopular PA measures.

The decision by President Mahmoud Abbas to place the General Secretariat of the Palestinian Legislative Council (PLC) with all its staff, departments and facilities under the direct responsibility of the Speaker of the Palestinian National Council (PNC)[1] has sparked debate on the process of implanting PLO institutions into those of the Palestinian Authority (PA). The Basic Law, which created the PA institutions, including the PLC, and described their functions and jurisdiction, does not recognize the PLO institutions, including the PNC, as legitimate components of the PA structure. Imposing PNC control over the PLC creates a hybrid PA-PLO system and brings about a significant transformation of the PA’s political system. A serious debate is now underway about the wisdom and implications of this shift, particularly on the prospects for a safe transition of power in the event of a vacancy of the post of PA President.

Relying on political decisions to create an institutional or a "constitutional" foundation to ensure a smooth succession process, or filling the vacancy in the post of the head of state, will create an internal constitutional and political crisis due to the fact that the rules governing the selection of the head of state differ in PA legal system from that of the PLO’s. The PLO legal system relies on a decision by the Central Council for the appointment of the Head of State. In the PA legal system, article 115 of the amended Basic Law of 2003 stipulates that it applies throughout the “Transitional Period” and can be extended until the new Constitution of the Palestinian State comes into force." The same law stipulates that the President must be elected by the Palestinian people.

The vacancy of the post of Head of State poses an additional challenge to the Palestinian political system already under extremely complex circumstances. First, the system lacks legitimacy due to the absence of elections. Second, the internal division and the split between the West Bank and the Gaza Strip have never been as deep as they are today. Third, the hidden internal conflicts over succession and the jockeying for power within the PLO institutions and the PA civil and security agencies are mounting.

This Critical Policy Brief aims to review the shifts in the nature of the Palestinian political system, the placement of the PLO institutions into the PA and the impact of the decisions of the Central Council on the future of the succession process. It describes the two most likely options available today to fill the vacancy in the position of the president or head of state and examines the positions of the various parties with direct influence in the political system. The Brief seeks to make recommendations to state institutions in order to avoid an institutional conflict when the position of the president or head of state becomes vacant in the hope of reducing internal differences and preserving a level of legitimacy in the political system.

Three turning points in altering the Palestinian political system

In the last 10 years, there have been three shifts in the nature of the political system towards the process of placing the PLO institutions into those of the PA, that was established in 1994 on the basis of the Palestinian-Israeli Oslo Accords, under the guise of transitioning from PA institutions to State of Palestine institutions. The first turning point came following the elevation of the status of Palestine at the United Nations to an observer state in November 2012. One of the manifestations of this decision was the replacement of the name of the Palestinian National Authority (PNA) with the State of Palestine in official Palestinian institutions, thereby removing the title of the “President of the PA” from the President's signature on presidential decrees and other decisions and replacing it with the title of “President of the State of Palestine” and Chairman of the Executive Committee of the PLO.

The second turning point came following the decision to dissolve the Legislative Council, in accordance with the Constitutional Court's interpretative decision on December 12, 2018, to "dissolve the Legislative Council and call for legislative elections within six months." Now, the phrasing of the decrees changed. As of issue 152 of the Official Gazette, issued on 19 February 2019, the customary words "on the basis of the provisions of the amended Basic Law of the year 2003 and its amendments” were removed from the decrees’ introductory statements to that of "based on the statute of the Palestine Liberation Organization." Moreover, the decrees now omitted any reference to the article was written in all decree stipulating that the “law by decree must be presented to the Legislative Council at its first session for approval,” an article that had been until then contained in all laws by decree.[2] This constitutional change was an attempt to abolish the existence of the PLC from the political system and to assign a substitute in the form of the PLO Central Council, which was now, in the PNC’s 2018 decision, granted the full legislative and oversight powers of the PNC.[3]

The third turning point came in the PLO Central Council’s decision in its 31st session on 6-8 February 2022, which called for "the need to continue to work to adapt the legal status and international relations of institutions of the State of Palestine in accordance with General Assembly Resolution 19/67 of 2012 that recognized the status of Palestine as a state. The Central Council asserted its jurisdiction and constitutional powers over the executives’ organs and institutions of the PLO as well as the PA. One of the manifestations of the central council's decision was the president's decision to place the General Secretariat of the PLC “under the responsibility of the Speaker of the National Council." The Central Council now holds its meetings at the PLC building; essentially turning it into the Parliament of the State of Palestine, as a fait accompli.[4]

 

Conflicting constitutional rules governing succession

A safe process of transition for the high office, one that maintains the legitimacy of one of the most important constitutional authorities in the country, requires the implementation of clear and agreed upon constitutional and legal rules, respect for the roles of existing political institutions, and the exercise of constitutional powers in a manner that preserves rule of law and strengthens public institutions. Unfortunately, in the event of a vacancy for the post of the PA President, the probability of conflicting constitutional and legal conflict is high given the contradictions between the rules governing the transition envisaged in the Basic Law compared to that of PLO by-laws and that of the PNC’s various decisions regarding the selection of the president of the State of Palestine.

Article 37 of the amended Basic Law 2003 states that the position of the president of the PA becomes vacant in case of death, resignation, or loss of legal capacity on the basis of a decision of the Supreme Constitutional Court and the approval of the Legislative Council by a two-thirds majority of its members. In any of these cases, the speaker of the PLC assumes the presidency for no more than 60 days, during which free and direct elections are to be held to elect a new president in accordance with the Palestinian electoral.

Law by decrease number 1 of 2021, which amended the 2007 election law, stipulates the direct election of the PA president by the Palestinian people. Article 3 stipulates that the person calling for elections is the Head of State of Palestine, chairman of the Executive Committee of the PLO.[5]

Accordingly, the speaker of the PLC must serve as the interim president, which of course assumes the prior existence of a parliament. Yet, none of the other actors in the Palestinian political system can serve in that capacity, as this constitutional rule has not granted the interim presidency to any of the other parties in the political system. Given the fact that the PLC has been dissolved, the Palestinians will have to confront the prospect of a constitutional and legal vacuum and potentially a crisis. This provision is also based on the assumption that the political system relies on democratic rules for the political transition. However, if the need arises in the near future, the Palestinians will face a conflict of constitutional rules due to the absence of the PLC or a parliament directly elected by the Palestinians. This fact puts the Palestinian political system in constitutional crisis.

On the other hand, the provisions of the PLO Statute or bylaws refer to the mechanism for selecting the chairman of the Executive Committee of the PLO in the event of a clear vacancy of the post. Article 13, section 2, stipulates that "the chairman of the Executive Committee is elected by the Committee members", which is elected only by the PNC. However, at its 23rd session in Ramallah, the PNC transferred to the Central Council all its powers.

 

The two likely options for the selection of the president

This section of the paper reviews two options that are most likely to be relied on to choose the next Palestinian president based on the constitutional rules governing the formal political system under the status quo. The analysis does not take into consideration, non-institutional political or societal transformations that may arise and force a change in the structure of the existing political system. It also excludes the possibility of holding general elections in the very near future.

 

Option #1: the chairman of the PLO Executive Committee becomes president

Following the vacancy of the position of president, the Chairman of the Executive Committee the PLO would be nominated as president of the state of Palestine. He assumes the position by a vote in the Central Council. Article 13 of the PLO Statute provides for the mechanism for selecting the chairman of the Executive Committee as outlined above.

This option is easy to make and only needs a session of the Central Council. It does not require presidential elections in the foreseeable future; at least in the absence of the ability to hold them, and keeps both positions "the PLO chairman and Head of State" in the hands of one person to prevent a conflict of powers between the pillars of the dual political system. It promotes the process of dissolving the PA political system in favors of the PLO institutions at the expense of the public institution established after 1994 under the Oslo Agreement. The Chairman of the Executive Committee is also able to deal with international and regional parties, especially since he will be a well-known member of the Committee and does not need international recognition or external legitimacy.

However, this option carries with it multiple risks, including internal power struggle within Fatah in light of the potential rivalry and jockeying for positions of influence. Also, it will probably exacerbate the division between Fatah and Hamas, and will worsen relations within the PLO institutions and increase the opposition of other members of the PLO institutions.

Finally, this option poses serious risks to the prospects of a future Palestinian democracy by squandering the opportunity for elections and for the citizens to choose their president. It doing so, it will be a clear violation of articles (5)[6] and (34)[7] of the amended Basic Law of 2003 which stipulates that the President must be directly elected by the Palestinian people. It will also be in violation of article 37 of the amended Basic Law of 2003 governing the vacancy of the post of President. Such violations will reinforce the shift towards a more authoritarian regime in which no elections are held and in which the executive and legislative powers remain in the hands of a single individual.

 

Option #2: PNC Speaker becomes an interim president:

This second option assumes that the PNC Speaker becomes the interim president. This option is consistent with the current tendencies within the PLO Central Council and its February 2022 resolutions.  One of those stated that “The Central Council assumes "its constitutional powers and oversight mandate over the executive bodies, organs and institutions of the PLO, the PA and the work of unions, trade unions and associations in accordance with the laws governing their work."

One of the most important advantages of this option lies in the fact that it is relatively more consistent than the previous one with the provisions of article 37 of the Basic Law governing the transfer of power in the event of a vacancy in the office of President. It is also consistent with the decisions of the Central Council. Furthermore, it maintains the hope that presidential elections will be held within 60 days of the vacancy of the post of President and show some respect for some of the provisions of the Basic Law, especially articles 5 and 34. It also contributes somewhat to alleviating some of the immediate conflicts and rivalries within Fatah over the succession issue. It may also be accepted, or at least not rejected, by other PLO factions. 

On the other hand, this option carries with it multiple risks, including with regard to residual internal conflicts within Fatah. Given the fragmentation within the movement, the selection of its candidate for the presidential elections might not be easy. Needless to say, any general elections will exacerbate the division within the movement. Moreover, conflict between Fatah and Hamas will not disappear, particularly over the selection of the interim president, a job Hamas might think has been stolen from it. This option also has risks to the nature of the political system by effectively placing the unelected Central Council as an alternative to the elected PLC and in doing so, violate the clear provisions of the Basic Law of 2003. On top of everything else, nothing in this option guarantees the holding of any general elections in the aftermath of its implementation. In the meanwhile, the emergence power of the interim presidency might become permanent.

 

 

Conclusion:

There is no doubt that the above-mentioned analysis strongly raises the concern about the PLO’s identification and immersion into the PA and the substitution of PA institutions by those of the PLO. This concern becomes more serious when it comes to the issue of succession at a time when the holding of general elections in 60 days cannot be taken for granted and might be delayed for a long time.  In this case, the PLO will be under pressure given its obligations under the Oslo Agreement and its various annexes. The failure to hold general elections also increases the risk of the lack of legitimacy in the entire PA and its public institutions and the prospect of internal strife. 

 

The choice between the above-mentioned options must be based on the assessment of which one is more consistent with the provisions of the amended Basic Law, and is better able to open the door for the holding of general elections, particularly presidential elections, thereby reducing the prospect of the emergence of a highly authoritarian regime, one that monopolizes both the legislature and the executive authorities while being rejected by the majority of the public and factions. It must also be based on the assessment of which one is more likely to help reduce the likely gap in the positions of the various Palestinian factions, not just within the PLO but also within Fatah’s various blocs and with other Palestinian groups.  In this case, the second option, the one that allows the speaker of the PNC to become the interim president, seems to be largely in line with these criteria and might help mitigates the illegality and lack of legitimacy that will soon overwhelm the entire political system.

يشير خطاب الرئيس عباس أمام الأمم المتحدة في أيلول (سبتمبر) 2021 واللغة الحريصة التي استخدمها إلى أنه يدرك حجم المأزق الذي تجد السلطة الفلسطينية نفسها فيه اليوم وقلة الخيارات التي تمتلكها. فالأوضاع الداخلية تستمر في التراجع ولا يبدو أن هناك إمكانية حقيقية في ظل الوضع الراهن لإجراء انتخابات عامة أو مصالحة أو لإحداث انطلاقة اقتصادية. كما أن العلاقة مع إسرائيل ستبقى تراوح مكانها على المدى المنظور حتى بعد انتقال رئاسة الوزراء في الائتلاف الحكومي الإسرائيلي الراهن ليائير لبيد. إن من المؤكد ان قدرة الائتلاف الراهن برئاسة نفتالي بينيت، أو أي ائتلاف آخر قد يأتي بعده، على الدخول في عملية تفاوضية جاده شبه منعدمة. كما إن المجتمع الدولي، وعلى رأسه الولايات المتحدة، لا يمتلك الرؤيا ولا الإرادة السياسية للقيام بدور يتجاوز ما يفعله الآن من إدارة للأزمة بشكل يمنع حصول انفجار ويضمن عدم حدوث تغيير جوهري على العلاقة الفلسطينية-الإسرائيلية. ولعل الأوضاع الإقليمية العربية وانهيار الإجماع العربي الرسمي حول المسألة الفلسطينية أوضح دليل على ضيق الأفق المتاح أمام الطرف الفلسطيني.

هل يسمح هذا السياق المتشائم للطرف الفلسطيني بالبحث عن بدائل تتجاوز السعي للحفاظ على الوضع الراهن؟ وفي حالة الاعتقاد بوجود إمكانية لذلك، ما هي هذه البدائل؟ هل يمكن لما يسمى بمفهوم "تقليص مساحة الصراع"، وهو نهج ينادي به بعض قادة الائتلاف الراهن في إسرائيل، أن يشكل إطارا لتنظيم العلاقة الفلسطينية-الاسرائيلية على المدى القصير حتى في ظل استمرار التوقف في العملية السياسية؟ تهدف هذه الورقة للبحث في السياسة الفلسطينية الراهنة، وخاصة كما عبر عنها خطاب الرئيس عباس أمام الأمم المتحدة. تخلص الورقة للاستنتاج بأنه رغم وجود البدائل فإن السلطة الفلسطينية، نظرا للقرارات التي اتخذتها خلال السنوات القليلة الماضية وتلك التي اتخذتها خلال الأشهر الستة الماضية، ليست قادرة اليوم على تبني أي منها، وأن أفضل ما يمكن توقعه خلال السنة أو السنتين القادمتين هو أن تنجح هذه السلطة في التأقلم مع الوضع الراهن، رغم كل مساوئه. لكنها تشير أيضا لخطورة الانجراف الفلسطيني والدولي وراء مفهوم "تقليص مساحة الصراع" لما لذلك من أثر مدمر بعيد المدى على مستقبل حل الدولتين.

 

سياسة الرئيس عباس المعلنة:

أكد الرئيس عباس في خطابه أمام الجمعية العامة للأمم المتحدة قناعته أن "سياسات المجتمع الدولي وهيئات الأمم المتحدة قد فشلت جميعها حتى الآن" في حل الصراع أو إلزام إسرائيل بالقانون الدولي. لكن، وفي تناقض واضح مع هذه الحقيقة، التي هي محل إجماع فلسطيني داخلي، عاد الرئيس ليؤكد أن السلطة الفلسطينية ستتوجه لمحكمة العدل الدولية" لاتخاذ قرار حول شرعية وجود الاحتلال على أرض دولة فلسطين، والمسؤوليات المترتبة على الأمم المتحدة ودول العالم إزاء ذلك". وفي تناقض غير مفهوم أضاف الرئيس قناعته بأنه "سوف يتوجب على الجميع التقيد بنتائج ما سيصدر عن المحكمة بهذا الصدد، فالاستعمار والأبارتهايد محظوران في القانون الدولي، وهما جرائم يجب مواجهتها ومنظومة يجب تفكيكها"[1]. إن من المؤكد أن الرئيس يدرك هذا التناقض في سياسته المعلنة. لكن هذا التناقض سيختفي إذا أدركنا أن السياسة الفعلية للسلطة ليست الاعتماد على المجتمع الدولي والأمم المتحدة لإنهاء الاحتلال وانما الاعتماد عليهما لإدارة الصراع ومنع التدهور في الوضع الراهن. إن مما لا شك فيه أن الرئيس وبقية النخبة السياسية الفلسطينية للسلطة الفلسطينية يدركون أن أفضل ما يمكن توقعه من محكمة العدل الدولية هو انتصار معنوي يضاف لما تم تحقيقه سابقاً بخصوص جدار الفصل في عام 2004. وكان ذلك القرار الاستشاري الذي أصدرته المحكمة قد أكد آنذاك أن على إسرائيل التوقف عن بناء الجدار وأن وثيقة جنيف الرابعة تسري على المناطق الفلسطينية المحتلة.[2] لم تتوقف إسرائيل عن بناء الجدار وعن تجاهل التزاماتها الواردة في وثيقة جنيف الرابعة. اما بالنسبة للشكوى الفلسطينية المقدمة للمحكمة ذاتها في أيلول (سبتمبر) 2018 ضد الولايات المتحدة بشأن نقل سفارتها للقدس، فإن المحكمة لم تقم حتى الآن بإصدار أي بيان أو توضيح بخصوص موقفها رغم مرور ثلاث سنوات على تلك الشكوى. يمكن بالطبع للمنظمات الدولية، بما في ذلك محكمة الجنايات الدولية التي تنظر هي الأخرى في شكاوى فلسطينية متعددة، أن تساهم في تعزيز الحرب الدبلوماسية التي تقودها السلطة الفلسطينية ضد إسرائيل، لكن من الخطأ قياس النجاح في هذه الحرب بأكثر من الحفاظ على الوضع الراهن. فهو لن يجبر إسرائيل على إنهاء احتلالها ولن يجبرها على وقف الاستيطان أو حتى وقف هدم البيوت. بل لن يجبرها على العودة لطاولة المفاوضات.

قام الرئيس عباس في خطابه أيضا بالعودة لموضوع كان قد تطرق له مراراً خلال السنوات العشر الماضية وهو تخيير إسرائيل بين حل الدولتين وحل الدولة الواحدة. لم يهدد الرئيس هذه المرة بالتخلي عن حل الدولتين، على العكس أكد التزامه بذلك الحل. لكنه في الوقت ذاته تقمص دور المحلل السياسي لينقل رسالته لإسرائيل بأن الوضع الراهن الحالي هو "تكريس واقع الدولة العنصرية الواحدة" وأن "شعبنا الفلسطيني والعالم بأسره لن يقبل بذلك، وستفرض المعطيات والتطورات على الأرض الحقوق السياسية الكاملة والمتساوية للجميع على أرض فلسطين التاريخية، في دولة واحدة". يدرك الرئيس أن التحليل السياسي ليس بديلاً عن صنع القرار وأن الاستمرار في تبني حل الدولتين من الطرف الفلسطيني في ظل تأكيده هو نفسه بأنه لا مستقبل لهذا الحل إنما هو تخلي عن دوره القيادي في صنع السياسة، إذ لا يجوز للطرف الفلسطيني الاستمرار في تبني حل الدولتين إلا إذا كان يرى في حل الدولة الواحدة تهديداً جوهرياً لمصالحه الحيوية. لكن الرئيس في تحليله السياسي عرض رأياً معاكساً إذ لمح إلى أن دولة واحدة بحقوق متساوية هي مصلحة فلسطينية عليا مثلما هو حل الدولتين. من الواضح إذاً هنا أن سياسة الرئيس عباس ليست سوى الحفاظ على الوضع الراهن، أي التمسك بحل الدولتين رغم استحالة تحقيقه والتلويح بحل الدولة الواحدة في استمرار للحرب الدبلوماسية ضد السياسة الإسرائيلية بهدف الإبطاء من عملية التسارع نحو "تكريس واقع الدولة العنصرية الواحدة".

أخيراً، لوح الرئيس بتغيير صيغة الاعتراف بإسرائيل عندما تساءل "لماذا يبقى الاعتراف بإسرائيل قائماً على أساس حدود العام 1967". وكان قبل ذلك قد أشار لإمكانية عودة الشعب الفلسطيني "لحل يستند إلى قرار التقسيم رقم 181 للعام 1947، الذي يعطي دولة فلسطين 44% من الأرض، وهي ضعف مساحة الأرض القائمة على حدود العام 1967". لا يوجد في هذه الصيغة التي طرحها الرئيس ما يشير لسحب الاعتراف بإسرائيل كدولة، وحتى لو قام الرئيس بإبلاغ إسرائيل رسمياً بقرار كهذا فإن ذلك لا يغير شيئاً من الوضع القانوني الراهن المتعلق بالاعتراف المتبادل بين منظمة التحرير واسرائيل. لكن بالطبع لو حصل هذا التغيير في صيغة الاعتراف، وهو أمر مستبعد تماما، فإن ذلك سيضيف لبنة جديدة في الحرب الدبلوماسية التي تديرها السلطة الفلسطينية ضد إسرائيل لكنه لن يؤثر في طبيعة العلاقات القائمة بين الطرفين بما في ذلك الاستمرار في التنسيق الأمني والمدني.

 

"تقليص مساحة الصراع": سياسة الائتلاف الحكومي الإسرائيلي الراهن

تشكل السياسة الإسرائيلية الراهنة تجاه المسألة الفلسطينية استمراراً للسياسة اليمينية السابقة مع قدر بسيط من التعديل. تنطوي هذه السياسة على عناصر ثلاث تشكل على ما يبدو الحد الأقصى من التوافق بين أطراف الائتلاف الحاكم الراهن، وتشمل الموقف من حل الدولتين ومسار المفاوضات السياسي، والتقدم في مجال الاستيطان، والبحث في مبادرات استعادة الثقة. أما بالنسبة لقطاع غزة بالذات فلا يبدو أن هناك تغييراً ذي مغزى في سياسة نتنياهو السابقة التي تعمل على استمرار الحصار والإغلاق، واستمرار الانقسام، مع منع حماس من الوصول لوضع تشكل فيه تهديداً عسكرياً حقيقياً لإسرائيل، ولكن بدون التهديد بحصول أزمة إنسانية أو التهديد بإسقاط سيطرة حماس أو قدرتها على ضبط الأمور الأمنية والمدنية في قطاع غزة.

تحت ضغط أمريكي شديد أعلن نتنياهو لفظياً قبوله حل الدولتين وذلك في خطاب جامعة بار إيلان في عام 2009. لكن رئيس الوزراء الحالي يرفض صراحة وعلنا هذا الحل مؤكدا لقاعدته وحلفائه في اليمين أنه أكثر تشددا من نتنياهو. كذلك، بالرغم من دخول حكومة نتنياهو سابقاً في مفاوضات برعاية أمريكية في عامي 2013-2014 للتوصل لتسوية دائمة للصراع فإن الحكومة الراهنة ترفض الجلوس على طاولة المفاوضات مع الطرف الفلسطيني.

أما بالنسبة للاستيطان فإن الائتلاف الحاكم قادر على ما يبدو على المشي بخطى بطيئة، في مشاريع استيطانية كبيرة لها القدرة عند اكتمالها على إلغاء المسار السياسي التفاوضي حول حل الدولتين. فمثلاً، بدأت الإدارة المدنية مطلع هذا الشهر الاستماع للاعتراضات على البناء في منطقة أي- 1)  E-1) الواقعة بين القدس وأريحا، وهي مرحلة هامة في المراحل الأخيرة من عملية التخطيط قبل إعطاء الموافقة النهائية على البناء وطرح العطاءات.[3] تقسم هذه المستوطنة، إن قامت، الضفة الغربية إلى قسمين معزولين شمالي وجنوبي، وتعزل القدس عن الضفة الغربية، وتجعل من المستحيل جعل القدس الشرقية عاصمة للدولة الفلسطينية.

كذلك بدأت إسرائيل خلال الشهرين الماضيين في التحضير للبدء بعملية التخطيط لبناء مستوطنة كبيرة شمالي القدس في موقع مطار قلنديا وحوله، بين رام الله والقدس، تحتوي على تسعة آلاف وحدة سكنية.[4] وفي جنوب القدس أقرت لجنة تخطيط إسرائيلية في منتصف هذا الشهر خططاً للدفع بالبناء لآلاف الوحدات السكنية في مستوطنة جفعات همتوس، التي ستبنى على أراض مصادرة من شرافات وبيت صفافاً وتشكل موقعاً عازلاً بين القدس الشرقية وبيت لحم. وكانت الحكومة الإسرائيلية قد أقرت في تشرين ثاني (نوفمبر) 2020 البدء بالعطاءات للبناء في تلك المنطقة.[5]

وفي القدس الشرقية تتقدم خطط البناء الاستيطاني فيما يعرف بمستوطنة "وادي السيلكون" التي ستقام على مساحة 250 ألف متر مربع في قلب وادي الجوز وسيؤدي بناؤها لهدم منشآت تجارية لا تقل عن مائتين يمتلكها سكان فلسطينيون من أبناء المدينة، وكان قد تم تسليمهم إخطارات بإخلاء المنطقة في منتصف عام 2020[6]. كذلك، لا تزال قضية أصحاب البيوت الفلسطينيين المهددين بالطرد في الشيخ جراح عالقة في المحاكم بدون حسم بانتظار تسوية بين المستوطنين وأصحاب البيوت. ترغم هذه التسوية أصحاب البيوت بالاعتراف بأنهم لا يملكون هذ المنازل مقابل السماح لهم بالبقاء فيها حتى حين.  أخيراً يشكل قرار محكمة الصلح الإسرائيلية في السادس من هذا الشهر بالسماح لليهود بالصلاة الصامتة في الحرم الشريف تغيراً غير مسبوق في العلاقات الفلسطينية-الإسرائيلية منذ الاحتلال الإسرائيلي. وبالرغم من أن القرار اللاحق من المحكمة المركزية، بعد يومين من قرار محكمة الصلح، أبطل قرار محكمة الصلح هذا فإن صدور ذلك القرار يشير بوضوح إلى التآكل التدريجي الحاصل على الصيغة المعروفة "بالوضع الراهن" التي سمحت بدرجة من الاستقرار الهش في العلاقات الفلسطينية-اليهودية في منطقة الحرم الشريف، وقد يؤدي هذا التآكل إلى تشكيل بؤرة انفجار قادمة.[7]

لكن في الوقت الذي لم يكن متاحاً للطرفين الفلسطيني والإسرائيلي البحث في قضايا حياتية هامة ذات مغزى تتعلق بالوضع الاقتصادي والاجتماعي والحياة اليومية للفلسطينيين فإن رئيس الوزراء الإسرائيلي بينيت أعلن أن لإسرائيل والسلطة الفلسطينية مصلحة مشتركة بتحسين أوضاع وظروف حياة الفلسطينيين. وقد اجتمع وزير الدفاع الإسرائيلي بيني غانتس مع الرئيس الفلسطيني في شهر آب (اغسطس) 2021 للبحث في إجراءات لبناء الثقة بين الطرفين بهدف تقوية الاقتصاد الفلسطيني، كما صرح الوزير الإسرائيلي[8]، والبدء بحل قضايا "لم الشمل" العالقة لآلاف من الفلسطينيين، "وإقراض السلطة" الفلسطينية نصف مليار شيكل من أموال الضرائب التي تجمعها إسرائيل نيابة عن السلطة الفلسطينية. كما أن تقدماً قد يكون أحرز على صيغة الاتصالات الخلوية في موضوع الجيل الرابع، وذلك إضافة لزيادة أعداد العمال العاملين في إسرائيل، وفي مجال السماح بإصدار رخص للبناء في المنطقة المصنفة جيم في الضفة الغربية. تنبثق هذه الخطوات تجاه السلطة الفلسطينية مما تسميه إسرائيل سياسة أو نهج "تقليص مساحة الصراع"[9]، وهي السياسة البديلة لمفهوم "حل الصراع" القائم على أساس التوصل لتسوية سياسية لإنهاء الاحتلال. وكان رئيس الوزراء الإسرائيلي قد عرض سياسة حكومته هذه على إدارة الرئيس الأمريكي بايدن رداً على محاولات الإدارة الأمريكية استكشاف حدود الخطوات السياسية الممكنة في ظل حكومة بينت.[10]

 

معادلة جديدة:

نحن إذاً امام معادلة جديدة: استعداد فلسطيني للقبول المؤقت بالوضع الراهن، وحكومة إسرائيلية جديدة متسلحة بمفهوم يدعي "تقليص مساحة الصراع" فيظهر تشددا أكبر في العملية السياسية وانفتاحا أكثر في خطوات بناء الثقة. إن من الواضح بالطبع أن هذه السياسة لا ترضي الطرفين الفلسطيني أو الدولي، لكن أحداً لا يعترض عليها بحد ذاتها وإنما على كونها بديلاً عن عملية سياسية لحل الصراع. وبما أن الولايات المتحدة ومعظم اللاعبين الدوليين يعتقدون أن الظروف الراهنة غير ناضجة للعودة لمفاوضات سلام، فلا يوجد في الحقيقة أي معارضة حقيقية للسياسة الإسرائيلية. وقد تعاطت الإدارة الأمريكية بإيجابية تجاه خطوات بناء الثقة وشجعت الطرفين على المضي قدماً بها. كذلك تعاطى الطرف الفلسطيني معها بقدر من الإيجابية إذ رأى فيها فرصة لتعزيز مكانة السلطة المتراجعة. وفي الحقيقة، فإن الجمهور الفلسطيني نفسه كان قد أبدى في منتصف أيلول (سبتمبر) تأييداً من الأغلبية (56%) لخطوات بناء الثقة من خلال تحسين الظروف المعيشية في الضفة الغربية وقطاع غزة، مثل لم الشمل أو توفير أموال إضافية للسلطة الفلسطينية، ولم تزد نسبة من رأت في ذلك عملاً سلبياً عن 35%.[11] 

فهل يتيح الإدراك الفلسطيني بأن الحفاظ على الوضع الراهن هو أقصى ما يمكن توقعه والاستعداد الإسرائيلي لتبني صيغة "تقليص مساحة الصراع" خلق مسار فلسطيني-إسرائيلي خال من الصدام وأكثر استقراراً خلال السنة أو السنتين القادمتين مما شهدنا خلال السنتين الماضيتين؟ وما مغزى الاستقرار قصير المدى على التطورات بعيدة المدى؟

إن الإجابة على هذا السؤال قصير المدى قد لا تكون بالضرورة سلبية رغم وجود عوائق واضحة أمام ذلك، إذ قد تشكل عوامل الشد الفلسطيني وضغوط الإئتلاف الاسرائيلي عناصر استقرار قصير المدى في ظل المعادلة الجديدة. فمن جهة، يشكل التنافس الحاد بين السلطة الفلسطينية وحركة حماس عنصر توتر واستقطاب كبير في السياسة الفلسطينية وخاصة بعد الحرب الرابعة بين حماس وإسرائيل في أيار (مايو)2021. كما يشكل ضعف الشرعية والأداء الذي يعتري مكونات السلطة الفلسطينية دافعا لها للعمل على تقليص ذلك النقص عبر كسب النقاط مقابل حماس، إما من خلال تحقيق مكتسبات للجمهور الفلسطيني، حتى ولو كان ذلك فُتاتاً من الطرف الإسرائيلي، او من خلال إدارة حرب دبلوماسية واسعة النطاق ضد إسرائيل. لكن السلطة الفلسطينية ستجد نفسها على الأرجح مجبرة على العمل في المسارين معاً: الحرب الدبلوماسية وخطوات بناء الثقة. إن هذه النتيجة ستكون محصلة شبه مؤكده للجانبين الآخرين في السياسة الإسرائيلية: رفض المفاوضات وحل الدولتين والبدء بخطوات محسوبة في مشاريع استيطانية لها القدرة على حسم مستقبل حل الدولتين، كما أشرنا أعلاه.

بالنظر إلى سياستها الراهنة، لن تكون السلطة الفلسطينية قادرة على بلورة ردود أكثر فاعلية في مواجهة الحصانة التي يتمتع بها الوضع الراهن. فهي مثلاً لو أرادت استغلال مفهوم أو نهج "تقليص مساحة الصراع" وتعزيز خطوات الثقة لتنطلق نحو آفاق أكثر اتساعاً من خلال استغلال التطبيع العربي مع إسرائيل لخدمة المصالح الفلسطينية، فلن يكون لها القدرة أو الإرادة السياسية على استغلال اتفاقات التطبيع للدفع قدماً بخطط فلسطينية لتعزيز الوجود الفلسطيني في القدس أو الاستثمار في المنطقة جيم، أو حتى إقناع الحكومة الإسرائيلية بالتراجع عن أي من خططها الاستيطانية الحاسمة الراهنة. إن أي استعداد من السلطة الفلسطينية للتعامل بإيجابية مع التطبيع العربي سيفتح الباب أمام فيضان من التطبيع مع إسرائيل، تكون السعودية على رأسه، مما سيساهم في تحجيم القضية الفلسطينية عربياً ويزيد من العزلة الفلسطينية، كما سيزيد من عزلة السلطة الفلسطينية وقيادتها، ومن ضعف شرعيتها، وسيعطي حماس مدخلاً أكبرا لتعزيز مكانتها وقيادتها للشعب الفلسطيني كبديل عن الحركة الوطنية.

في المقابل، لو ارادت القيادة الفلسطينية تعزيز حربها الدبلوماسية من خلال بدائل سلمية لمقاومة الاحتلال، مثل استغلال الغضب الشعبي الكامن من أجل تصعيد المقاومة الشعبية وإشراك عشرات الآلاف من المدنيين الفلسطينيين فيها، فإنها ستجد نفسها عاجزة عن القيام بذلك نظراً للفجوة الهائلة الموجودة حالياً من انعدام الثقة بينها وبين الجمهور الفلسطيني. وفوق كل ذلك ستجد المؤسسة الأمنية الفلسطينية في مشاركة شعبية واسعة النطاق مقدمة لعسكرة المقاومة، وإيذاناً بفقدانها للسيطرة على مجريات الأمور، وقد تتخوف من تحول الغضب الشعبي ضد إسرائيل لتهديد داخلي ضد السلطة نفسها.

في الجانب الإسرائيلي ستكون القيادة اليمينية تحت ضغط كبير للرد بحزم على الخطوات الفلسطينية الدبلوماسية المعادية رغم أن خطاب الرئيس عباس قد أعطى الحكومة الإسرائيلية سنة كاملة بدون خطوات دبلوماسية ضارة لها. لكنها على الأرجح ستكون مدركة للضغوط التي ستعمل القيادة الفلسطينية في ظلها وقد تتركز ردودها على الخطوات الدبلوماسية الفلسطينية في تسريع وتيرة الاستيطان بدلاً من وقف خطوات بناء الثقة. وقد تتعامل إسرائيل بإيجابية مع أي تحول فلسطيني نحو العمل في مجال بناء الثقة من خلال عملية التطبيع العربي لما لذلك من تأثيرات إيجابية على القبول العربي بها وتطبيع العلاقات معها رغم تجميد العملية السلمية واستمرار تعميق الاحتلال.

 

الخلاصة: تقليص أم زيادة مساحة الصراع؟

غني عن القول أن المدخل الوحيد لتقليص مساحة الصراع هو تقليص مساحة الاحتلال والاستيطان. لكن المضمون الإسرائيلي لهذا المفهوم سيعمل على عكس ذلك، إذ ستتقدم خطط البناء الاستيطاني وسيتعمق على اثره الاحتلال ويتعزز. فهل تستطيع السلطة الفلسطينية في ظل هذا الواقع أن تكتفي بجهودها الدبلوماسية المتواضعة مع الانخراط في خطوات بناء الثقة وقبول ما تراه إسرائيل فتاتاً متاحاً في ظل أولوياتها في الحفاظ على وجودها وفي ظل أولويات الحكومة الإسرائيلية في الحفاظ على تماسك ائتلافها الحكومي الراهن.

إن من المرجح أن تكون هذه هي فعلاً سياسة السلطة الفلسطينية للفترة القادمة قصيرة المدى. فالسلطة غير قادرة على بلورة موقف فلسطيني موحد بدون مصالحة وانتخابات وتغيير جوهري في نظامها السياسي، مما يتركها سلطة ضعيفة وهشة ولا تحظي بالاحترام الدولي. في ظل وضع كهذا لن تبادر أي من القوى الدولية الفاعلة للضغط على الطرف الإسرائيلي لوقف عملياته الاستيطانية الراهنة أو لقبول حل الدولتين والدخول في مفاوضات سياسية لحل دائم. لكن هذا الرضوخ من الطرفين الفلسطيني والدولي للوضع الراهن سيعني حتماً وصول الأوضاع الفلسطينية-الإسرائيلية إلى مرحلة اللاعودة عندما تدرك كافة الأطراف أن حل الدولتين لم يعد قائما.

ليس هناك مفر من القبول بهذا الاستنتاج، إذ إن الاعتقاد بأن أمام القيادة الفلسطينية (التي قيدت نفسها بالمواقف المذكورة أعلاه) بدائل أخرى هو مجرد تمنيات فارغة. كذلك، فإن الاعتقاد بأن الجماهير الفلسطينية لن تقبل مرغمة بهذه النتيجة هو تقدير في غير محلة، إذ لا توجد قيادات أو حركات أو أحزاب سياسية قادرة، أو راغبة، في ظل الوضع السائد اليوم على التأثير على الجماهير الفلسطينية وكسب ثقتها وطرح بدائل للسياسة الراهنة للقيادة الفلسطينية. ينطبق هذا القول على من هو قادر منها، مثل حماس والقوى المؤيدة لمروان البرغوثي، وغير القادر، مثل قوى اليسار والقوائم الانتخابية الجديدة أو جماعة دحلان. أما المجتمع الدولي فلن يتحرك بحزم في أي اتجاه إذا اعتقد بغياب فرص النجاح. لكنه قد يتحرك في حالة حصول انفجار فلسطيني-إسرائيلي جديد، وهو أمر غير مرجح في الوقت الراهن، باستثناء قدرة حماس العالية على المخاطرة مما يعطيها المزيد من المكتسبات على حساب السلطة الفلسطينية.
